They're fighting an uphill battle. MMOs are expensive to create and maintain, and I don't think there are enough people who want an MMO and aren't already playing WOW or SWTOR. In fact, when SWTOR came out, many users they attracted were not new MMO customers, but WOW defectors.
Economics should take care of most of their concerns. When they keep pumping out yearly sequels, eventually people will get tired of it and the franchise dies. Remember the Tony Hawk and Rock Band franchises? They were the Call of Duty of their day, now they're dead or dormant.
I could be wrong, but I believe that, as part of the usage agreement, Bethesda owns the rights to any mods you create, and can use them in any way they wish without credit or compensation.
Decent redesign, but not really worth buying again if you already own the original design. The worst feature on the original was the d-pad, so I'd like to see if this one is as good as the one on the dualshock.
One thing I hate is a lack of save/checkpoints. Even AAA titles, such as Metroid Prime and the GTA series, suffer from this. This is no love and hate thing, this is pure HATE, and it's a bigger pain than any of the above mentioned stuff. The only thing worse are bugs that prevent you from completing the game. While most of these are budget titles and licensed junk, the otherwise great Lego Star Wars II is crippled by this flaw.
