If someone invades your house in the night, is it legal to blow their head off with a shotgun?
This topic is locked from further discussion.
in California if someone breaks into your home or someone is after and is treating your life and enters your home you have the right to kill him/her. BUT if you kill someone on your front yard you go to jail for murder.
thats why the joke here is if you kill someone quickly drag his body into your home so you dont get in trouble
If the person who broke into your house poses a significant threat to your life and well being then yes. But if not, like they dont have any weapons, just hit them over the head with something hard and call the cops.
Edit: 600th post! Woot!:P

Did you just kill someone that entered your house?
In my state it is. If you kill someone in your house for breaking in just call the police to come pick up the body. They don't even have to have a weapon just the act of breaking in allows you to shoot them. Happened a few times in my town since I have been living here.
Only in Texas. :P

So you think that people have no right to defend themselves? If a person breaks into your house, you assume they are a threat to your life. Why would anyone break into your house in the first place if their intentions were benine?
It's tough to say because I think not to long ago, a home invader won some lawsuit against a 'would be victim' of his for using "excessive force" on him when he was caught red handed by the home owner. Or something to that effect
Then again, if your life is being genuinely threatened, Yes. Or if you can corroborate a story to make it seem as though it was in self defense, then perhaps.
I don't know, I suspect it depends on the circumstance. But just to be safe, it's best to let them kill you instead of defending your home and family. You could get sued or something.
In Australia, the theif can sue you if you injure them when they broke into your house and steal things or seriously threatens you.

Good strawman. You have the right to defend yourself as long as you don't use lethal force or excessive force on the intruder. Just because you can't kill someone in that situation doesn't mean you're not entitled (or unable) to defend yourself. The assumption is also pretty faulty, it makes plain sense to say that he's a threat to your property but thieves don't really break into somewhere with the intention to kill or maim - being thieves and all. So yeah, thieves break in with the intention to steal; not to say they cannot become violent when spotted, but the assumption that all intruders are going to intend to end you simply is silly and empirically wrong. It should probably be done on a case by case basis with more flexibility in retrospect, but ehhh, like anyone would take on such a suggestion. I live in California and I don't even know about the front yard part. WOW, the world we live in. Good to know though. (drags body) JK! :P That made my night though, thanks man.in California if someone breaks into your home or someone is after and is treating your life and enters your home you have the right to kill him/her. I prefer to keep it the way it is (least in the state I live in though I have a feeling you aren't in the US). Shoot on sight if someone breaks in and its legalhe can't sue you if you blow his head off....It's tough to say because I think not to long ago, a home invader won some lawsuit against a 'would be victim' of his for using "excessive force" on him when he was caught red handed by the home owner. it is legal in some states, but not in some. in some states your life needs to be in danger for it to be justified. if the guy is unarmed, you could be charged for manslaughter. lxsetothat's downright ridiculous. why, do you have to wait for the burglar to have a weapon pulled out? are you supposed to be asking, "hey, burglar, you have a deadly weapon on you? if not, im not gonna kill you. if so, let me know now so we can have a mortal kombat!" ..that's a dumb law.
Well I have heard of a homeowner that shot a fleeing burglar in the leg, dragged him back inside the house and killed him there.
He wasn't charged with anything.
Though this was in the US, As far as Norway goes it's only in self defence if your life is actually threatened.
I would blow his brains out if he´s armed or if he is taking something I really like. If not I would shoot somewhere close to him... he´ll panic and crap his pants and run... or cry in his knees while I call the police
