GOP hopeful wants to make oral sex a felony

Story

The conservative Republican candidate for Virginia governor has begun advertising his efforts to reinstate an archaic and unconstitutional state law that make consensual oral or anal sex acts illegal.

The law makes consensual oral or anal sex acts felonies, even for married couples who commit the acts in the privacy of their own homes.

 I really hope the GOP keeps this shit up. I really, really do.

The thing is sodomy isn't covered under the First Amendment. Also, most, if not all of the exceptions to the First Amendment are based on some other law being broken. Child porn isn't protected speech because the person producing it would need to commit statutory rape in most cases. Yelling fire in a crowded theater isn't protected because it may incite panic and cause people to become injured or killed. I can't speak for your other example but there may be some justification (possibly related to health risks) I'm not going to take the time to look up for now.

With sodomy, the Supreme Court made it clear that punishing people for consensual acts will not be allowed. The decision does not make it okay to engage in sodomy with a minor or an animal and forced sodomy is a form of rape. That candidate really doesn't have a leg to stand on trying to get an exception to the SC ruling since every so-called indecent outcome of sodomy is already outlawed under other sexual assault laws.

Virginia politics are dominated by that kind of crackpot Tea Party Republican.  Virginians must be proud.  The mission of the Tea Party is to turn the Republican Party into the Christian version of the Taliban and seize control of the government.  The ugly truth they don't admit publicly is that their goal is to replace constitutional democracy with a fundamentalist Christian theocracy.  Look at the way they govern, or fail to, in Congress and in the states where they are in power.  They will succeed in their quest to subvert democracy if the voters don't toss them all out of office.

What you're talking about is something entirely different from what the topic is about. Distributing obscene materials is not the same thing as consenting adults engaging in private acts behind closed doors. And anti-sodomy laws, such as the one proposed here, have been ruled unconstitutional by the Supreme Court.

And no, it takes a little more to have something ruled "obscene" than just being unacceptable by the majority. Were that the case then untold scores of books, music, films, games, etc would have been declared obscene by now. (re: http://en.wikipedia.org/wiki/Miller_test)

I doubt that the law is enforceable.  The Supreme Court's ruling on the issue years ago was clear and decisive.  The government does not have any authority to interfere with private, consensual relations between adults.  So-called sodomy laws are illegal.  The religious zealots who are attempting to re-impose them are just going to waste a lot of taxpayer money in their incessant quest to impose their religious ideology on everyone.

In several cases sodomy laws were made as a way to outlaw homosexual actions. A man and woman can have vaginal sex but that isn't the case with two men. The problem is when the laws aren't specifically detailed it by default outlaws heterosexual actions as well. And yes, people have been charged with consensual sodomy before in many different areas.

If two consenting adults wanted to take a poop on each other and film it and distribute it via the internet they can be prosecuted if the act can be proved it was done within the United States. Regardless if the act was between two consenting adults or not it's illegal.

Prostitution is a different issue in that it isn't the sexual activity itself that is illegal but the exchange of payment or other forms of compensation for sex.  I agree that the fundamental issue is the same, as it is a personal, consensual act between adults, but it would take another Supreme Court ruling to expand that concept to prostitution, and that would require having prostitution laws challenged in the courts.
