Mendezs 16-year-old daughter, All I really want is justice. My mom and I were best friends; she is the one I told everything to. I just cant explain the pain we are going through right now. Nothing I say will bring my mother back. She was my mother, teacher, best friend, the teen continued. She didnt even get to see [my brother and I] graduate from high school, and that was her dream.

After listening to statements from Mendezs family and the toddlers family, Judge Gill decided to sentence Padilla to 48 hours in jail after she serves 180 days under electronic surveillance and house arrest. She must also remain on probation for three years.

Judge Gill said Padillas willingness to plead guilty played a big factor in her sentencing Friday. He said he believes Padilla is genuinely remorseful.

Tragic story for all involved. If she was as sleep deprived as she said she shouldn't have been driving, though. That can be as dangerous as drunk driving.

i still consider that a baby. like 2-5 is what i consider a toddler.

I don't understand the point of jailtime and electronic surveillance in this situation.  To be honest, if i accidentally killed someone while driving i would probably voluntarily cut up my drivers lisence and never drive again.  I wouldn't want to take the risk of doing it again.  Hopefully she will be more careful in the future (probably won't be).

Are you stupid? She should be serving jail time.

Opinions =/= Facts. Judge thinks the lady was remorseful, as such the judge gave her a lighter sentence (as judges are allowed to do)

Exactly and she knowingly drove her vehicle while excessively tired. She probably nodded off and snapped awake to the red light. There are numerous examples of wrecks happening for this very reason, yet no one thinks it will happen to them.

Ok if the baby is only one day old, what's she doing outside the hospital? Couldn't afford to stay there? And why was she driving and not her husband? I'm no doctor, but I know from experience that after a woman gives birth they stay at least a few days in hospital. This woman for some reason didn't and her husband, for whatever reason, decided to let his wife drive in that condition.

 

So... sounds like very gross irresponsibility.

But you've got to remember it was an accident, and that sending her to prison will create other victims too. I don't think locking her up is a good solution in this case, I'm happy she's able to stay with her new born baby, and a life ban on driving is understandable.

he's on probation because the nature of the case. he wasn't in the drivers seat punching the gas. in this thread's case, it's a clear cut answer on who's responsible and who should pay.
