This really pisses me off. Why did her husband allow her to drive?
A mother is dead and there is nothing being done.

Yeah, yeah, yeah 180 days house arrest/ surveillance and 3 years probation, but only TWO PHUCKING DAYS IN JAIL? I don't care if she was remorseful; this calls for more jail time than a measly 48 hours.
Tragic story for all involved. If she was as sleep deprived as she said she shouldn't have been driving, though. That can be as dangerous as drunk driving.MrPraline
Female privilege, women can do almost whatever they want and they will not be held to any sort of accountability.

she fuc king killed a person and almost killed another. Get real.
But she is not a killer. There is a difference. What she did literally makes her a killer. Not just a killer, but a child killer.
[QUOTE="Storm_Marine"]It wasn't intentional.....:| You killed a person, oops my bad? You know better than this LJ.at least give her a permanent driving ban.
The Law is so f ucked up at times, there are victimless crimes out there that will send you to jail for years, but in some cases you can cause serious harm to other people and you're given an almost free pass.

[QUOTE="RadecSupreme"][QUOTE="LJS9502_basic"] Then maybe you should have read the OP.....After listening to statements from Mendezs family and the toddlers family, Judge Gill decided to sentence Padilla to 48 hours in jail after she serves 180 days under electronic surveillance and house arrest. She must also remain on probation for three years.JustSignedUp
Are you stupid? She should be serving jail time.
lol no response from LJ, what a sad strange little man Sad? I don't know.....I have a life and haven't been back to the forum....I think it's more sad that you sit around waiting for a response because you don't have a life. The law does, in fact, take intent into consideration and an accident will not be treated as harshly as something done intentionally. If you don't like it.....too bad. Justice should never be without mercy.[QUOTE="LJS9502_basic"][QUOTE="Storm_Marine"]It wasn't intentional.....:| You killed a person, oops my bad? You know better than this LJ. At least take her driving licence away from her, ffs. If this was a man, he would of got charged for manslaughter and got his ass in jail for a very long time. Ye if she is genuine remorseful that jail time is abit pointless, but still should be punished harsly such as taking her driving licence away from her for life.

Neither are drunk drivers.
yes this is correct, when u drive sleep deprived ur driving impaired, thats being irresponsible which requires a harsh PUNISHMENT!! wich is a huge red flag that says dont have her drive in the first place.[QUOTE="Storm_Marine"][QUOTE="wolverine4262"] -3 months house arrest -3 years probation .wolverine4262
she fuc king killed a person and almost killed another. Get real.
But she is not a killer. There is a difference. she admitted to being sleep deprived and still went out and drove dude. that in my eyes says she is guilty of more i mean holy shit dude they crack down harsher on drunk drivers now and this woman got a slap on the wist.
the article also stated she knew she went past the red light so again she was aware. i personally think she just didnt care and lets not pretend morons like that dont exist because they do

It was grossly negligent... If you you just gave birth one day prior, are sleep deprived, and incapable of watching what is ahead of the vehicle you are speeding down the street in, you should not be driving.
She is guilty of manslaughter at least. This is absurd. If this were truly accidental that is one thing, but to claim sleep depravity and giving birth as an excuse for killing a person by accident isn't accidental, it is negligence plain and simple.
If the driver gets no jail I really hope the nanny's daughter cleans her out in civil court for wrongful death, the defendent plead guilty so it is an automatic judgment against her, she doesn't have to prove anything, just a matter of how much she is awarded.
She will feel remorse for the rest of her life so jail time would unlikely work as a deterrent in this case.
However, many have had way longer jail sentences for less. She is very lucky to get a sentence that almost qualifies as a slap on the wrist.

Jail isn't simply a deterrent, it is punishment.

It's both.
The real question is why do we give any idiot a license who wants one? It should be much harder to get a license and it should include an IQ or general intelligence test.
As far as the topic it sounds like justice was served.

Ditto. This means she wasn't fit to drive. She should be held accountable to the same extent to anyone else who drives impaired. Justice system failed.
It's not a risk for women to drive after giving birth.:?That's terrible. Why was she driving after just giving birth?
lowkey254
Either way, she should have to pay for such a crime.
Had it have been a male he would be under the jail.
[QUOTE="Nibroc420"][QUOTE="LJS9502_basic"]It was an accident...they do happen in life. Damn OT is stupid....LJS9502_basicNow you're trying to rationalize a woman who's carelessness resulted in the death of a mother and injured a child not even 2 years old? Guess i shouldn't be surprised, it is LJS.I bet everyone in this thread that has a license has at some time driven under less than ideal circumstances. And the law does differentiate between deliberate and accident....and so it should. I'm assuming they all work part time jobs and have no kids or else they would be driving sleep deprived every day.
Looks like no one gets what they deserve in this case. An innocent woman loses her life, her children lose a mother, and the driver has to live with what she did for the rest of her life all because she made a pretty small lapse in judgement. A tragedy all around. :(
I don't see a problem with this. She probably did not realize how tired she actually was, and maybe she's never experienced that before. It's not like she was drunk and decided to drive. She just fell asleep while driving.
It's extremely unfortunate, but sometimes, things are just accidents. Jail isn't going to fix anything.
