Ubisoft Files Lawsuit Against Google And Apple Over Alleged Rainbow Six Siege Copycat

Ubisoft has filed a lawsuit against both Apple and Google for failing to remove a game it says ripped off Rainbow Six Siege in numerous areas.

Rainbow Six Siege is one of the most popular multiplayer games on the planet, so it comes as little surprise that it has its share of imitators. One such imitator, however, is doing more than that in eyes of Ubisoft. The company has filed a lawsuit against both Google and Apple for selling a game Ubisoft says is a direct ripoff. [Update: Just a few days later, Area F2's developer has announced the game will be taken offline as of May 20. There's no specific mention of the lawsuit, and refunds are being offered for purchases made during its beta.]

As reported by Bloomberg, Ubisoft's suit against Google and Apple concerns the game Area F2, a multiplayer shooter created by Chinese mega-corporation Alibaba and its website Ejoy. According to Ubisoft's suit, the game allegedly copies Rainbow Six Siege's user interface, including its final score screen and the operator selection screen. Area F2 is available in the United States on mobile devices and is currently in a free period, while Rainbow Six Siege is only on PS4, Xbox One, and PC.

Prior to filing the lawsuit, Ubisoft said it had told Apple and Google that the game infringed on its copyrights but the games were not taken down. The lawsuit was filed in Los Angeles, and neither Google nor Apple have commented on it yet.

Rainbow Six Siege is one of Ubisoft's strongest ongoing revenue-generators, making more than $1 billion since it launched in 2015. This is done through microtransactions for new operators and other content, but maps are available for free and keep the community together. It makes sense why the company would be litigious with the game, as it has not received a sequel and continues to acquire players and receive new updates. A cooperative-focused game, Rainbow Six Quarantine, is scheduled to release later this year. As of now, that's still the title.

It's like going to the liquor store, buying a bottle of cheap whiskey, getting sicker than a dog after drinking it and then suing the store.

You don't sue the store. You sue the company that produced the whiskey. If you can't sue the company that produced the whiskey, you put on your big boy pants and just deal, but Ubisoft should be pursuing action against the producers of the game, not the digital stores that make them available. That's just ignorant.

If the courts agree with Ubisoft that the ripoff game is infringing on their copyright- which is not necessarily guaranteed- then the marketplaces that sell said game are legally required to stop. Why do you think websites like Youtube have to make an effort to take down videos that infringe on copyright? You think Google can just go "Sorry Disney that someone uploaded the entirety of Avengers Endgame, pursue action against anonymous user #2784295, we have no obligation to take the video down!" No, they take the video down because if they didn't Disney could sue them from providing a platform for their stolen content and causing financial damages due to lost sales.

The liquor store scenario is about a person seeking damages after being sold an unsafe product. If the courts ruled in favor of the person and decided the whiskey was poisonous and a recall was issued, the store absolutely could be sued if they refused to pull the product.

@dragoonmike: I believe Bluehole (PUBG company) did try to sue fortnite but were not successful and dropped the case before very long. However in this case virtually every element of Siege has been copied, literally down to the UI and some of the maps being practically 1:1 recreations. I don't know how successful Ubisoft will this case but it is not the same as suing a game for being in the same genre.

Ubisoft is about the size of a golf ball when compared to Apple and Google that together could be seen as the size of the sun. Good luck Ubisoft !!!! You won't make it up with DLCs on this one, google and apple lawyers will make mince meat out of you.

As a shareholder in Apple, Google, and Alibaba (this is true) and a game consumer who has bought many Ubisoft games that look pretty good, at first seem okay, and then turn out to be utterly boring crap - I say: crush UBISOFT mega tech companies. Crush them to hell!

I wouldn’t trade Ubisoft (the people who are making rayman, bge2, AC, the Tom Clancy games and many other core titles) for the other three who only make expensive proprietary electronics , STADIA , and Chinese knockoff companies all of whom should legitimately be destroyed.

It's kinda funny how lazy that chinese company were when it came to copying Siege that they did a pure copy and paste of the whole UI. You'd think making your own unique UI art would be the easy part.

Really hard to make a case for this but these type of cases can really go both ways because its all about having really good lawyers and convincing the jury.

As an example, Katy Perry lost a copyright
infringement lawsuit that was really ridiculous and has sent shivers down most musicians spine for a much much less serious issue. https://youtu.be/0ytoUuO-qvg

So, does Ubisoft have a case here? Yes they do. Can they win? Most likely.
Is it good for the industry? No.

The issue with the mess of the patent system and the copyright system at the moment is that it´s binary.
There is no shades of grey and that has created lots of trolls just taking advantage.

In this case in particular, sure Ubisoft is right. Look at the footage of Area F2. It is a complete ripoff. Down to the art design, gameplay, UI. There is literally no originality or presentation of a similar game but in a different way. The typical COD gaming sequel can even be more original then this.

The issue here is the total irresponsibility of the Area F2 developers and the repercussions to devs if Ubisoft wins.

Developer houses, publishers and so on have in general used common sense to try and not sue each other over and over again for common ideas and concepts. Makes sense after all.

Area F2 clearly disrespected this and now if Ubisoft wins, we have yet another case that can be used as defense for future cases. The issue is that those future cases might be between a big publisher vs a small developer that has done mostly original work but based on some popular concept.

It could be used to destroy emerging publishers/developers before they are too strong to compete.

It would be interesting to see how this plays out. I get that when promoting the game the fear might be that players will associate the two and think it a sequel or some such or if the game is sub par in quality potentially harm their reputation. By forcing the game to be taken down, the developer will have to change the UI design for western markets which isn’t a big deal 🤷🏻‍♂️ Right? Right?!?

It's almost impossible to successfully sue a company based in China for copyright infringement. So they that to go through the companies that are hosting the game. No different than filing a DMCA takedown for videos on youtube. But in this case apple and google haven't done anything so they are taking legal action in hopes that they will get off there ass and remove it.
