Major development in the Mar-a-Lago documents case. This relates to a possible obstruction indictment and to attorney client priviledge - specifically the crime fraud exception.

Evan Corcoran - Was/is Trump's senior lawyer who directed a junior lawyer to sign an affidavit saying a thorough search of the property was conducted and no other docs existed. She did sign that affidavit but was smart enough to hand write 'based on what I have been told' on the document.

This was obviously false since the documents were readily found during the FBI search.

The question has been what did Corcoran know and why did he direct the junior lawyer to lie?

Now we are getting a clearer picture. It turns out Corcoran taped and transcribed one or more conversations with Trump about these documents. (says something that Trump's own lawyer would tape and transcribe a conversation with him)

A 3 judge panel just ruled that Corcoran must appear before the grand jury and the transcript of the call(s) entered into evidence. The crime fraud exception has been invoked and Corcoran cannot claim attorney client priviledge.

DOJ clearly believes that Trump directed Corcoran to lie about the documents and has sufficient preliminary evidence to convince the first judge that the crime fraud exception is applicable. Trump appealled that and the 3 judge review panel unanimously agreed with the first judge.

Next stop will most likely be Trump appealing to the Supreme Court. He could try to appeal to the whole of the DC circuit judges first, but that is probably pointless.

Last interesting point is all of this happened in 24hrs.

@sargentd: What's to ignore? That's Cohen's lawyer please don't hurt me letter before he goes to trial. He was convicted, including on a campaign finance violation. Dude has subsequently written a book, provided all sorts of evidence and testimony. You can believe any, or all of it, or none of it...regardless that letter is irrelevant. It is the equivalent of a lesser mobster saying 'I didn't do nothing and neither did my boss' before getting convicted on 8 charges.

Fact is he pled guilty and stipulated to the fact that he made payments on behalf of Trump for the purpose of influencing the 2016 election while employed by Trump and possessing a campaign advisory position. He then received monthly payments from the Trump Organization for 'legal fees' in 2017 as reimbursement. All of this is on the record when he pled guilty. And all of this was made public as part of his guilty plea on 21 August 2018....6+ months after the date of the letter you reference.

You continue to simply parrot things with zero understanding of wtf you are talking about and without bothering to even question the truth, legitimacy, or relevance of any drivel that you read that reinforces your delusional views.

We don't know whether the strength of the evidence would result in a conviction, but that's why we have judicial systems. If indicted, Trump should get a fair trial...like anyone else. That's it, that's all.

The DA could be an idiot for all I know, but it would be illogical to indict someone on a charge that can't be prosecuted. That's my going in bias on evaluating the situation but I judge things by the facts, which I will wait for.

You are simply trolling a speaking point based upon someonelse's uniformed opinion because no one knows with any certainty what the charge would be. Therefore, you are parroting speaking points without spending any time evaluating the speaking points.

You can still think it is a wrong thing to do....not sure I would proceed either, as I don't have all the information. But stop echo chambering others without firing up a few brain cells and thinking for yourself. Otherwise your life is going to be misery. Democrats weaponizing the DOJ to go after political opposition. MSNBC reports Trump is going to be arrested on a book keeping error thats past statue of limitations by a NY DA. NY DA has to bump it up from a misdemeanor to a felony just to be able to bring it to court to get past those pesky statue of limitations..

This case is very weak, it's unprecedented to go after a presidential candidate like this. What did I say earlier in this thread?

NY DA is probably sweating now lol.. the microscope is on him now. The entire country will be paying close attention.

I won't be surprised if the NY DA folds on this now entirely. Especially if he can't see a way to actually convict, he may of realized he got ahead of himself, and this could end up backfiring BIGLY!! Or maybe not! Time will tell!!!
