Are you playing a game that uses the touchscreen? I believe the 3DS has pressure sensitive touchscreens, might not be tapping hard enough. Theres also somewhere in the settings that lets you calibrate it, you could try that.

I've noticed that when I play SSFIV, some of the touch screen commands require me to press a little more firmly on the screen.
no when i am at the 3ds home screen it just keeps going right and im not pressing anything i try to get to a calberating menu but the touch screen stops working. i think i might have to return it .
