You know I argued with so many store managers about this exact same thing. I was going to buy a copy of Transformers (the good one!) on the PS2 about 3 years ago, so I went to EB to see if they had it, since it was right down the street from where I lived.
I found the case on the shelf so I asked the kid, "do you have any sealed copies?". He said, "No, just the open floor display". I asked him to see the disc. He pulled the disc out of this haggard paper sleeve (like you get a driver/program disc on when you buy a sound card) and the disc had tons of scratches and fingerprints all ovr it. I told him that they must be crazy to sell that as a new game. He said, "well it's never left the store, so it's still new, but if you buy and walk out the door it's used." I said that the disc is thrashed and could hardly be classified as "new". I told the kid that I should get that for the used price since it's trashed. He said they can't do that, so I told the kid to stuff it and left.
Edit: The moral of the story is that they could have been selling me a used game at a new price, but how would I know the difference. I'm sure they scam people like that all the time.
They also seemed to have stopped opening 8 copies of the game just to fill holes on the shelves. I used to hate that! You'd go to buy a new game and the only ones they have left are the 20 opened copies with the discs in paper sleeves.
