Apparently some woman was misled into thinking that Nutella was nutritious by their commercials. So she won $3.5 million in a lawsuit, and $2.5 million of that money is going to consumers who file a claim.

You can be reimbursed up to 5 jars.

http://finance.yahoo.com/blogs/the-exchange/today-food-finance-nutella-not-broccoli-162956191.html

Here is the claim section

Well if Nutella was really saying it was healthy then this is good. Lawsuites like this keep companies from falsely advertising their products. If Nutella didn't actually make such a claim, then this is really stupid.

This is ridiculous, the advert basically says "Eat it as part of a balanced breakfast" which is what every product these days says, something along the lines of "Enjoy as part of a balanced lifestyle!". Are you seriously telling me this moron heard "Enjoy with fruit, milk, toast as part of a balanced breakfast" and went Eh, I'm sure I can just knock the other stuff out and it'll be fine, does she ****ing understand what the word balance means? Someone should make her sit on a see saw and then drop a god damn car on the other end to teach her how it works.

Nutella is available in a wide variety of countries including Canada and many of the member countries of the european union. Even in countries where it is not readily available, it can be ordered online and shipped their granted they have access to UPS or some other postal delivery service. It may have even been served on the international space station thus granting it offworld status. Very few foods can brag of that. It also may have been eaten in a submarine, thus granting it underwater status as well. Limiting your mindset to just america radically limits the number of ways in which Nutella can be experienced.

I know the lawsuit was because of false advertising, but the only reason she sued was because she gained weight.

Contains a lot of sugar. In fact, the first ingredient is sugar.

Yes, Nutella isn't healthy and yes, I don't like how the label says "Part of a nutritious breakfast" but that's why we have those nutrition labels. I mean, if you can't read it, you're stupid. It's very simple to understand and there's even an ingredient list to make sure it's nutritious.

But yeah, as the previous poster said before, I hate this country's obsession with lawsuits.

I don't consider false advertising to be frivolous though. This stops companies from falsely advertising their products. Yes, the fine is way too steep, but it still serves its purpose.

Good for the lady who sued them. Serves them right.

I remember seeing one of their ads portraying it as a good thing to give children for breakfast.

You'd hope parents would be smart enough to realize giving their children chocolate or whatever the hell Nutella isn't a good idea but screw the company for putting out crap ads like they did.

By the way, I love Nutella and all it's cheap no-name knock offs.

Eat more than you need without burning it off and you get fat. Easier to do when talking about processed foods. Of course, the same can be said about protein and fat.

Thank you. There is no such thing as bad foods. Only bad diets. If someone gets fat, it is because they consumed more than they burned...you could blame the sweet potatoes and brown rice as much as the nutella....perhaps even moreso as they're taking up caloric room of something more delicious!
