You seem to be completely ignoring the fact that, once again, intense, inescapable grief is much worse than just sitting in a jail cell. It's not as though someone who is rehabilitated is just like, "oh, yeah, I guess what I did was wrong, I'm better now". Why would the knowledge that that intense grief awaits someone if they commit a crime not be an equally large deterrence as the knowledge that they'll go to jail?

You do know that our prisons are over-populated don't you? So obviously a great deal of people are just not afraid of the consequences. You are just looking at the prisons, think out of the box, lots of people don't commit crimes because they know they can get in trouble. If you remove this you would be seeing people you never though about committing crimes actually doing it
