If this was to be introduced GS would lose about 75% of there memebers due to ban.
On top of that, what one person considers intelligent is not going to fly for someone else. Moderation would become completely imposible.

I completely agree. There is simply no way to define what an intelligent post is and it just wouldn't be fair. indeed...the ToS generally has enough rules to mean that the vast majority of stupid posts will get moderated anyway...and that is enough really...
