While there is some truth in that statement, the James Bond game licence is currently owned by Activision, so they would have to broker some sort of deal with Activision first to get any james bond game past, current, or future on the VC.I see no reason why Nintendo can not release the SNES or N64 versions of KI. Or Goldeneye for that matter.
Nintendo published both games, does that not give them the rights to those titles from those consoles? It's not like Nintendo is remaking the games, they are the exact same games that were already released years ago.
Perhaps what ever contract Nintendo and Rare had back then would still apply to these same games today...?

Nintendo owns Donkey Kong so Rare doesn't have ties to it
Diddy Kong is a handheld game, Microsoft allowes Rare to do work on handhelds but no consoles
and I think activision owns bond franchise now
