They're only making it a crime during riots or at an unlawful protest. So if you do something illegal while wearing a mask, it'll just be more illegal. Anything that would be legal without a mask (like the protest you've pictured) isn't going to be made illegal with one.

The states is obviously a complicated situation since it's ridiculously saturated with guns already and laws aren't going to change that (so I'd probably consider it an exception), but in general I don't think it should be a right.
