@deathstream @Busta Because videogame publishers are nobodies. They want to ban games. I'd wager they'd screw over a company before helping them. Nothing can be done to a person that violates a EulA agreement. Other than banning them from your service. Eula's are violated all the time with beta testers.

There is nothing to be gained from a user fighting against a Eula agreement. Just get another account. It's moot point really. It's a wall to fool and scare people like you.

@deathstreamMaybe "unconstitutional" was an over powering and incorrect word. It does violate first sale doctrine. It is a very grey area for digital works. And there is no EULA in existence, that can override that.


Eula is there as a wall that threatens legal action. They are banking on the fact whoever challenges doesn't have the clout or money to fight it to the fullest.

Like i said. there hasn't been a big fuss over it yet.

Contracts like Eulas are just a form of bullying. They have nothing "legal" on the books backing it up...yet.

@deathstream @Busta @DeViLzzz EULA's are unconstitutional. There hasn't been an instance where it has raised that much of a fuss. Many companies try to lay down their legalese. Doesn't put them in the right.


But you can lay down and give up your rights. You seem comfortable with it.

@deathstream @Busta @DeViLzzz It is a license yes. But it is not single use, nor is it non-transferable. You could _always_ make backs up copies for personal use. And there was _never_ a restriction on lending..or borrowing ( transferring the license). Apples..and apples. It's the greedy publishers that all of a sudden want to call it an orange.

@deathstream @DeViLzzz @Busta Buying the used version of the new car hasn't killed the motor industry. Nor has borrowing new books from the library killed the publishing industry. I can't understand your line of defense for this DRM business.

Not everyone is rich. Alienating gamers that can only afford to buy used most the time, will hurt the industry in the long run.

@deathstream @Busta It is, but if it isn't. One less thing to worry about. I like to borrow games and lend em to my friends. I'm constantly offering to let friends use my games. I know in today's society that can seem wierd.

And isn't ms using blue-ray? "real gamers don't buy used" ? _Real_ gamers buy used all the time! Have you seen the massive libraries of some "hardcore" gamers. Bulk of their games were bought used. How else do you go back to play classics you missed?

@deathstream @Busta Sony could have walked on stage and punched a baby in the face, then dropped the mic and walked off stage. And it would have won based on their no drm policy. That's just my opinion.

@deathstream @Busta Despite the hype. E3 isn't the end all be all. They didn't show many if any of their in house developer's games. Did they show a naughty dog game other than last of us? And i'm not just defending sony here.

Even MS has another event to show more after E3
