Okay, I know this isn't exactly SW material, but like every other news thread here, I posted this here to bring this to a lot of people's attention. And BTW, before you go "This belongs in the sticky!", yes, I'm aware it exists. But it's not about the game itself. ANYWAY, I just found this out on Kotaku, but apparently GAME is going through tough times right now. And as part of those tough times, some stores will not be receiving stock of Diablo III. Gamers who pre-ordered the game at one of the affected locations will not get their money back. Ever. Not even usable toward other games. Guess who this reminds me much of. (Hint: The CRAPpiest Japanese video game COMpany of this generation.)

Surely taking somones money for a product you can't supply and then refusing a refund is either fraud or theft. Got to wonder what thier legal obligations are with a pre order contract.

Same thing happened at Game in the UK with Mass Effect 3, it sucked. In fact I believe they've stopped trading with EA altogether until their finances get better. I wouldn't rely on them for anything right now unless its actually on the shelf. Wait... no refund either? Damn son

crazy. Is that legal though i mean i dont know how things work over there but i guess in the US there would def be some lawsuits flying. I mean when your pre order it's not like your donating your money to the cause or something. Your paying in advance for a product and if you don't get that product you should get you money back.

See that's punishing Blizzard not that crappy "GAME" company, Game is the one who is doing shady business practices, they are the ones who are not fulfilling their end of the bargain. Pirating games hurts the developer/publisher more than the crappy stores.

I can't be bothered reading through their Terms and Conditions at the moment, and I won't bore everyone with details about the Australian Consumer Law...but even if you could sue them (in the US or here in Australia), so what?

If the company has no money left, then you can't exactly get money back from them.
If the company has small amounts of money left, it'll head to the secured creditors first. The gamers would be at the back of the line of people trying to get money owed to them by GAME; they might not see a cent.

Having said that, I wonder if Blizzard are going to fix things up for everyone who missed out...

True i guess. Seems like they shouldn't be able to pocket the money if they haven't provided yet but then again i guess what would be the point of pre ordering . It would be nice if the say gave people copies that could prove they pre ordered at a store that wont be getting D3. Very unlikely to happen in reality though.

diablo tried to steal people away from quake 2 i remember AAAxKamikaze on heat.net lol would leave the game after me kicking his ass he would be like im gonna go play some diablo 2.

That guy was in his 30s or 40s i was like 16 lol 30-40 years old were more casual gamers than my era though.

It still related to the game and is the focus of this issue so yeah it still belongs to the sticky, but anyway that sucks that they can't at least refund those who preordered. They should get in trouble for that.

funny because D3 sets pre order records everywhere amazon uk and ger dont even have regular copys anymore. REGULAR !! let alone CEs This game is selling in the millions alrdy and it became playable a few mins ago Game is a masterpiece, deal with it

I get the feeling that if you take a payment toward a product, discover you won't be getting the product, and then tell that person the money they've put down will not in any way be refunded is illegal. Just a hunch.
