House Speaker John Boehner announced Wednesday he plans to file suit against President Obama over his alleged abuse of executive power.

"This is not about impeachment -- it's about him faithfully executing the laws of this country," Boehner said.

The speaker alleged that the president not only has ignored the law but "brags about it," decrying what he described as "arrogance and incompetence."

Boehner had been weighing such a lawsuit in recent days, over concerns that Obama exceeded his constitutional authority with executive actions. Republicans have voiced frustration with Obama's second-term "pen and phone" strategy of pursuing policy changes without Congress -- particularly environmental rules via the Environmental Protection Agency. Republicans also complained about numerous unilateral changes to the implementation of ObamaCare.

The lawsuit has not yet been filed. But asked Wednesday whether he intended to proceed, Boehner said: "I am."

"My view is the president has not faithfully executed the laws," he said. "What we have seen clearly over the last five years is an effort to erode the power of the Legislative Branch."

EDIT: I removed my comment about Boehner being next in line. I was mistaken. Sorry, guys :(

Interesting...and if it were to be that Obama was impeached, Boehner would assume the role as acting President. Hmm...

Boehner wouldn't become president unless Obama and Biden were both impeached. The courts wouldn't be able to impeach, the House would have to vote to bring impeachment charges against Obama and then the Senate would have to convict by a 2/3 majority vote. If that happened, Obama would be removed from office.

Oh great, another pointless lawsuit, paid for by the Taxpayers, that will get thrown out of court.

Boehner must be reeling since the Benghazi thing just ended with the capture of Ahmed Abu Khattala last week.. the GoP needs something new to try to rally their shattered party behind I guess.

One problem though:

TOTAL EXECUTIVE ORDERS BY PRESIDENT, As of Jan. 20, 2014:

FDR - 3,522

JFK - 214

LBJ - 325

Nixon - 346

Ford - 169

Carter - 320

Reagan - 381

Bush (41) - 166

Boehner should just go back to playing golf.

Can't wait until The GOP Primaries start up again. Truly the greatest reality show in the history of mankind and it works as a sit-com too. Hopefully hilarious characters like Rick Santorum and Michelle Bachmann return for the new season.

We'll see what happens. The Administration's unilateral modifications to Obamacare seem to be overstepping Obama's legal authority, plus it seems hypocritical for Obama to let his underlings modify the law, but then refuse to allow Congress to do so.

You're missing the point. It's not about the number of EOs per se, it's about specific policies, decision that may exceed the president's legal authority or violate some law or other. The number of total EOs doesn't matter, what matters is whether those EOs are within the president's authority or not.

From the article:

Ahead of Boehner's announcement, House Democratic Leader Nancy Pelosi ridiculed the prospect of a suit against the president.

"I make of it as subterfuge," she said. "They're doing nothing here. So they have to give some aura of activity."

Pelosi said the Republican caucus needs an "adult in that room."

LoL.

He also doesn't really get into any specfics of Obama exuding "King-like authority". This is just a big plublicity stunt at the cost of the taxpayers.

Obama became the first president to appoint nominees when the Senate was in a “pro-forma” session, which is when the upper chamber is briefly called to order and adjourned every few days.

That was the crux of situation. Obama trying to acquire powers that don't belong to him, not the constitutionality of the recess appointments.

@Netherscourge:

It is not the number of executive orders but the executive order itself. Executive orders are not to be used to make laws and circumvent congress. That is what Obama has done. Congress should impeach his ass along with Eric Holder.
