Sony's Triumphant Night

Why embracing consumer rights has thrust the PlayStation 4 ahead in the early stages of the next-generation console war.

'

A cheer erupted through the GameSpot war room. The topic of so many raging debates the last month--strict digital rights management, Internet requirements, used game sales--had pitted Microsoft clearly against the consumer. Team Xbox seemingly took every opportunity to punish their loyal customers, and those who were scared of having such tight restrictions on all of their gaming systems were terrified that Sony would follow suit. And then, with just a few words, all of those fears were eliminated. Sony proved that abject greed is not a curse that all companies are afflicted with. By saying no to the used game restrictions and always-online that Microsoft is so happily implementing on the Xbox One, Sony has elevated the PlayStation 4 as the console to grab this holiday season.

This is not a small issue. Consumers have been seeing their rights slowly siphoned away as companies have realized that our weakness for entertainment has caused us to accept even unsavory policies. We've complained on message boards that online passes are an unfair punishment for used game buyers. We've cried out on twitter that downloadable content often feels like pieces of the game have been removed from the core experience and then sold for a high price later on. We've stomached season passes that urge us to shell out money for content that hasn't even been announced. And through it all, we still bought games, because we love losing ourselves in digital entertainment for a few hours.

When Microsoft hinted that they would enact draconian policies on the Xbox One, it was clear that they had finally crossed the line. An Internet-wide campaign was created to pester Sony executives to do everything in their power to avoid a similar mistake on the PlayStation 4. This topic united players together into a rabid army intent on having their voices heard. We would not be shut out. We would not be shut up. And we would not relent. Loud and long we yelled for weeks, making sure that Sony understood the power of those who pay their bills. We had consented to the gaming companies' demands for too long. Our rights would not be taken away.

Microsoft is trying to change the definition of ownership on the Xbox One and it's failing miserably. Purchasing a physical product is not the same as a digital download. Microsoft is taking advantage of the technology inherent to video games because they can, but that doesn't make it right. Contrary to what those in Redmond claim, once we buy a game, we own it, and we can do what we want with it. Whether we resell it to a willing retailer, lend it indefinitely to a friend, or keep it in our permanent collection is our choice and ours alone.

No Caption Provided

We will not be punished for the sins committed by so many companies. The industry has been losing money the last few years, but that dip into the red is not because we have the freedom to buy and sell whatever game we desire. No, it's the reckless spending so many companies are guilty of, pouring millions upon millions of dollars into a budget when there is no chance the market will buy enough copies to support that investment. It's the deluge of soulless sequels that have been churned out and die on the shelf because consumers can see through their brown and grey façade. We are not the cause of these problems and should not be punished for them. Microsoft hasn't learned this simple rule. Sony has. And that's the biggest difference heading into the next generation.

The most important thing we should take with us is that our voice is important. We screamed and yelled and Sony listened. But the fight is not over yet. We need to continue to voice our dissent whenever publishers attempt to take away our consumer rights without offering any benefits in return. Remember always that these companies are nothing without our money funding them, so we ultimately have the power over their every action. If we don't like something, let them know, because the smart companies will listen to those that pay the bills. Today has been both a great and terrible day for the industry. Sony has proven that not every company has a dark side, but Microsoft's descent into anti-consumerism is a sad setback for those who have enjoyed their consoles for so long.

Hell I'm buying an Xbox One if only to combat fanboyism. The worst thing about the video games industry is the fanboyism and bias. The homer editors at IGN for years have been doling out 9.5's and 10's for every exclusive game that comes out to their favourite console. Tom Mc Shea above may as well throw on a Sony hat with the lack of integrity in his journalism as he comes out a big loser today as the end result is that BOTH Microsoft and Sony are leaving DRM up to the publishers and at the end of the day you like all the fanboys got duped by Sony as if they really cared about gamers they would have a firm policy in place that deters publishers from DRM involving their system. But they don't because they don't care. The difference is at least Microsoft isn't pretending to be the good guy while crossing his fingers behind his back.

@dsm_guy What are you talking about? DRM isn't left to publishers. It's integrated with the console. XBox One is using an online check, Sony is using the older disk-check style. People don't like the online check. It tries to control when, where, and even IF we can use the software we bought.

I think you're confusing DRM with the used game thing. Which XBox Is leaving to publishers. Sony is not. You can resell/trade/share your games all you want.

@Polynecro You're missing the point. It's not the "inconvenience" of having to check in every 24 hours with the Xbox. It's a matter of ownership. It doesn't matter if you have to check in once a month or once a year, you're essentially asking for MS's permission to use your own console and play your own game. "The ONLY thing separating them will be the 24 hour check in." That's the biggest understatement of the century. I'm the biggest Xbox fanboy ever (on my fifth xbox) but what MS is doing transcends fanboyism and gaming. There is a not-so-hidden Orwellian agenda behind the Xbox One. Long live Sony!

@FighterforJC @Polynecro Thank you. Jesus Christ these people miss the point over and over again. And I like the apologist "If they just remove the DRM the only thing left will be the check in". What? The online check in IS part of the DRM, and wrong for all the reasons you just gave.

Agreed. I let my Xbox Gold subscription lapse last week (I've been a member for 6 years) until I could confirm which direction each company was going. Immediately after watching the Sony press conference, I went and bought a PlayStation Plus subscription, and I'm pre-ordering my PS4 tonight. Thank you Sony for listening, thank you.

@Mendax2013 @SpyderWeiss I know right! I'm so excited, none of this "You get two free games, and two of your choices are Assassin's Creed 2 and Halo 3!" Really Microsoft? I can find those in the bargain bin.

Great article! Good on Gamespot for calling Microsoft out publicly. And this: "It's the deluge of soulless sequels that have been churned out and die on the shelf because consumers can see through their brown and grey façade." is absolutely correct, imo. I have been buying fewer and fewer games over the past few years specifically because the quality has been decreasing, so they've been losing my dollars due to quality, not piracy.

BTW to all current PS3 owners this is off topic and i do apologize but seeing as we had enough of this Microsoft headache i would like to remind you that Phase 3 of Final Fantasy 14 is starting on the 14th of this month, and the PS3 users can finally join in!! so if you own a Square Enix account expect to download the beta on PSN store.

One thing I think some MS fanboys don't realize is that GS didn't write cause they jumped on the "bandwagon." In the past whenever they reviewed a game that was multiplat. The 360 version was always the version I saw as the default version reviewed, so thats not the problem. What Tom McShea is saying is that MS is basically telling us what we're allowed and not allowed to do, and what we have to do to play a game. We shell out over 60 dollars for a game only to find out that we just paid all that money to let MS cuff us with all these policies. As a gamer, that doesn't work for me. When I buy a game, its MINE, when I lend someone a game, its MINE and if my internet connection isn't working, guess what I do? I play games and if MS is taking that away with these mandatory check-ins, whats the point of supporting that? Why support a company that takes away our rights as gamers? How can anyone benefit from this? Plain and simple, its idiotic on a scale never before seen.

I'm still a bit worried there will be something about the PS4 that will cause issues. No where near the level of Micro$hits mind you, but after the horrible presentations given my M$... I'm very very worried about consoles at the moment. But if I was going to definatly buy a system, it would be a sony PS4.

@xeoneex66 I can assure you that sony will not do anything to kill this Hype it's a match made in heaven... only thing tht might kill the buzz would be release date being December after Xbox... which i doubt tbh. Other than that sleep at peace nothing will go wrong simply because they know very well they can't afford to make that single mistake with these stakes.

@Gamernametaken @xeoneex66 I don't care about release dates I just dont want them promising things and then saying well... we did say this but we decided to do this instead... I guess i'm being overly paranoid, it's just that lately companies have pissed me off to the point I'm hesitant to purchase things nowadays. example is the notorious SimCity blunder from EA. And all that crap regarding miniscule DLC content etc... I know it's not the same exactly but lately the foundations of the industry have been shaking pretty bad and the aftermath is leaving a sour taste in my mouth.

@rdwolf260 @xeoneex66 @Gamernametaken Yes, this is what I'm concerned about myself. They can take away as easily as give. And IF I'm going to buy I'm going to be very careful about stipulations and read between the lines to make sure that I'm not going to have to pay for things or be screwed out of content or features promised from them. This is one thing PC has the major advantage over. You can't screw yourself over with a PC you built yourself. Unless you are just that Sadomasochistic :P

That is why I'm not buying ANY system at launch. Even then there's no guarantee that a company will continue to hold up their end of the deal after I give them my money. Sony seems like a darling in this thing, however, it's still the same company that REMOVED features from their PS3 retroactively with an update. There's no guarantee that once the get 10x the userbase that XO has that they won't turn around and flip the switch on their own shitty DRM. I'm hoping that won't be the case but you never know nowdays.

The biggest Mistake Microsoft can make this year will be not listen to the angry mob... so MS if you have someone here quietly reading i advise you remove all those stupid restrictions especially those used game ones... and game loaners, since we know you can't turn off the always on anymore due to a stupid design.

@Gamernametaken It doesn't matter. The fact they completely ignored their main consumer base, gamers, from the time we heard the rumors till the rumors were proven truth. They have already lost. There is nothing they can do with this system, short of completely redoing it from SCRATCH, that is going to salvage this PR nightmare they have brought upon themselves. I'm very happy to say, Micro$hits just dug themselves a hole they cannot dig themselves out of...

@xeoneex66 @Gamernametaken Meh. Sadly I know lots of people who are willing to buy the xb1 as-is, even with all the restrictions/privacy issues. I've heard 'I'll buy the PS4 first and the xb1 later once the price drops' many times already. Honestly, this scares me. If xb1 sells enough copies then next gen you can expect MS to become even greedier and Sony to take the same route MS took this gen, just as they've taken the same route as xblive by requiring a subscription to play online...

@ry0uz @xeoneex66 @Gamernametaken It is sad though. This way of thinking is destroying the gaming industry. I want it to flourish with new consoles as next as the next person. But becuase people have the attitude, eh so what, I'll buy both systems and then I'll have best of both worlds, it's hurting everything by supporting greed and corrupt business practices. I don't even know if we should blame Micro$hits. Blame the people who buy these systems and games and support this corruption.

I wholeheartly agree. Sony and Playstation 4 represents freedom of chioce for the gamers. Sony is doing right by us. Microsoft on the otherhand will sell 24.5 million Xbox Ones in the 8th generation. Sony PS4 will sell another 150 million consoles. The 8th Generation console war between Sony and Microsoft has just begun. Sony can cue the "Na Na Na Na Hey Hey Goodbye song" to Microsoft. Long live Sony

@Megavideogamer I can confirm that 150mil because that is the exact number i came up with b4 next gen consoles come out, and despite all those who think otherwise i for one know this to be as true as day is bright and night is dark in almost all places. IF Microsoft does not change anything until November? their Xboxone sales will be only those hardcore fans who refuse to listen to reason and blindly follow and eat up everything Ms sells.

Voice of reason on here. There are many sheep that will cry and say you're buying a "license" not a product. BS, when you're buying a physical copy, you're buying a physical copy. If I buy Windows 7 and install it on my PC, when I sell that PC to someone else and give them a copy of Windows 7 disc, that person is not punished in anyway. I bought my 1 license, then I'm able to transfer it without going to an "authorized" retailer.

I think what people forget is that Microsoft is mandating EVERY disc to be installed (read: copied) to HDD and you don't need the disc after that. So now they're turning ALL their customers into potential pirates and treating them as such. So I buy a game and have it installed on my HDD and then give it or sell it to someone else, they do the same, but now BOTH of us can play the same game while only 1 copy was purchased and we can't have that. WTF Microsoft?! If a game is installed to HDD on Xbox 360, if I wanted to play it I at least need to put the disc in so that there's no copies out there. Why can't XO do the same? Greed, pure and simple.
