Sony may "monitor and record" all PSN activity on PlayStation 4

Updated Software Usage Terms say PlayStation maker can collect voice and text data to enforce Terms and to comply with law.

Ahead of the PlayStation 4's launch this week, Sony has updated its Software Usage Terms (via Polygon) to explain that the company may "monitor and record" any or all PlayStation Network activity, including voice and text message data. The company can do so enforce the Terms and to comply with pertinent law, Sony said.

"We reserve the right in our sole discretion to monitor and record any or all of your PSN activity and to remove any of your UGM [user-generated media] at our sole discretion, without further notice to you."

The Terms of Usage apply to all authorized PlayStation systems, including PlayStation 2, PSP, PlayStation 3, PlayStation Vita, and PS4.

"Any information collected in this way, for example, your UGM, the content of your voice and text communications, video of your gameplay, the time and location of your activities, and your name, your PSN Online ID, and IP address, may be used by us or our affiliated companies to enforce these Terms and the SEN Terms of Service, to comply with the law, to protect our rights and those of our licensors and users, and to protect the personal safety of our employees and users," the document goes on.

This information can be handed over to the police or other appropriate authorities, Sony said. Accepting the Software Usage Terms means users consent to this.

Though Sony may monitor and record PSN activity, the company said users should not worry about the company having a permanent and exhaustive record of their online actions.

"We can't monitor all PSN activity and we make no commitment to do so," Sony said.

The updated Terms of Usage also points out that all PlayStation software is "licensed, not sold," meaning players acquire rights to use software, but do not own said software. As such, players are not permitted to resell disc-based games or downloads, Sony said, unless Sony grants permission. This policy has been in place since the original PlayStation, though Sony has never blocked the sale of secondhand games.

Sony confirmed at the 2013 Electronic Entertainment Expo in June that the secondhand market on PS4 will work just as it does currently on PS3. No restrictions for used games will be in place.

The PS4 launches this Friday, November 15 in North America.

the intentions between Sony and Microsoft are different. See on Sony's end they're monitoring a service that THEY own, and you agree to it when u sign up for their service. It's no different than being on film when you walk into a store.


Microsoft on the other hand was trying to invade your personal life.

Look at it like this:

Sony: you go to someone's house, eat THEIR food and use THEIR bathroom, and they have cameras set up in their house for security purposes. You cannot tell them to turn them off because it is THEIR house, and they're only doing it to be safe, and make sure you aren't doing anything you're not supposed to.

Microsoft: Someone comes into YOUR house with a camera and films everything you do even when you ask them not to.

So there's the difference, one is internal, and done for good reasons, the other is external and done for malicious reasons.

If you walk into Wal-Mart you cannot tell them not to film you, you're using their service, however Wal-Mart reps cannot walk into your house and film you. therein lies the difference.

it's pretty cut and dry when you look at it from a logical standpoint. If people aren't doing anything wrong on PSN, they have nothing to worry about. In fact I'm hoping this causes more banning of racist morons on Call of Duty and other such things. I'm tired of those people ruining gaming experiences.

And if you're gonna be stupid then you deserve to be treated as such. just like the idiots who talk about getting stoned on Facebook. That's not something you publicly share.

@oversoul53 You knew they had a camera before you invited them into your house. You knew they were going to use it. Solution? Don't invite them in. There is nothing malicious about what Microsoft is doing. They're trying to embrace the 'future'. Facebook, youtube, google, they're all doing it. Don't think Microsoft is being secretive about this.

Personally, I hate it. I hate them tracking what I do so they can recommend things I 'may' like. I loathe predictive technology, except for predictive text. It's why I hate facebook, youtube, google+, the list goes on. I try my best to disable all options that allow 'recommendations'. It's why i'm getting a PS4, perfect misanthrope console.

I hear the phrase, "if people are afraid of their government blah blah blah". I say blah blah blah after that because the biggest key point to take away from all these numerous amounts of people is that people should be obedient to their government lest they be punished. This isn't a Sony issue or Microsoft issue. Hell it's not even a internet issues, it's a loss of empowerment for the people. We have become so wrapped up in accepting great crimes against our own liberties that we've begun to accept and sadly even defend it as OK. It's not ok for a government to treat it's people like potential threats, it's not ok to go through more steps to change your driving information to a new state then it is to get a US passport and it's certainly not ok to accept total disregard for our privacy over a false sense of security.

These are regulations, rules and policies that many electronics and software companies have. Not just Sony!! The difference is that nobody ever reads the policies! They scroll down to the "Accept - Do Not Accept" section and complete the process. If you read them you'd know that these aren't new or evil. They are created to protect the owner (Sony) and it's affiliates from legal problems. I'm all for monitoring PSN. If it means my money and ID are protected then do what you have to do to keep it safe. The other upside is that more modders and hackers will get banned.
