Silicon Knights-Epic suit going to federal court

Judge rules Too Human developer's case and Gears of War developer's counterclaim have enough merit to go before a jury.

In 2007, one of the most heated legal battles in the game industry was between Too Human developer Silicon Knights and Gears of War creator Epic Games. The battle was initially sparked in July of that year, when Silicon Knights sued Epic over allegedly holding back support of its Unreal Engine 3 to reallocate resources to Gears of War development. Epic quickly countersued, accusing the Canadian developer of trying to steal the Unreal Engine 3 technology for its own engine.

Little has been heard about the suit since November 2007, when a judge refused to dismiss the developer's original complaint against the Unreal Engine maker. Recently, though, the suit has resurfaced, according to Gamasutra. On March 24, a judge reportedly ruled that the suit could proceed to federal court, where a jury will decide the merits of Silicon Knights' claim and Epic's counterclaim.

In its latest filing, the court found that "…Epic had a possible motive to deceive SK into entering into the [Unreal Engine] License Agreement in order to fund the development costs of its own games and delay the work of SK and other competing licensees on their video games."

In a statement, Epic downplayed the decision, telling Gamasutra that, "The court entered judgment in favor of Epic on several claims, rejecting Silicon Knights' claims that it could cancel its license agreement, that Epic interfered with its contractual relationships with publishers, and that Epic has acted unjustly under the license." The company went on to say that, "The court did not rule on the merits of Silicon Knights' remaining claims. … Epic remains confident that it will be fully vindicated at trial."

Silicon Knights president Denis Dyack also tried to put a positive spin on the decision, saying, "When Epic first went public about our case to the press, they said that our claims were without merit. Two separate federal court judges have now disagreed with Epic, and have ruled that the case does have merit."

@poppen695 amen to that brother ! I mean obviously if silicon knights really doesn't deserve to win then maybe they shouldn't. But it would be great to see too human 2.

@Batosai001 Good point, but if they car doesn't break down why would you complain about the mechanic or salesman? At most, they likely would've avoided working with Epic's engines again.

I'm on SK's side in all of this. While others may idolize Epic simply for putting out good games, I've never sided with a celebrity who committed a crime simply because I like them and I don't intend on starting now. While I'm neutral on SK's lawsuit until damning evidence is presented, Epic's dubious counter-suit is a good indicator of an egotistical "get what I want cause' I'm big" attitude companies get when they strike oil and try to keep it out of other's hands. Of coarse this is all just speculation.

Gears has amazing graphics but of all the games that were made by the same engine of gears, wouldn't be atleast one game that look the same as it? I don't think other developers who worked with this engine are too lazy to make their games look almost like gears who both developers worked with!!! This makes me think that Epic did tweaks to its enigne so other developers dont reach their optimized level with the engine, so you see the hype for gears everywhere, its all business lol

Gears is a great game for many reasons, graphics just being one of them. I don't have sympathy for SK in this case. Sounds more like they're blaming their mediocre game on Epic instead of owning up to their repititive and bland game design. Come on, it's Epic's own engine. Of course they're gonna know how to make it work better than everyone else! Not saying Epic didn't do something shady, I'm just saying this lawsuit sounds like the sucky player who thinks the guy who beat him was cheating. Sometimes this is true, but 99 times out of 100, the better player just knew the maps and weapons location better, or was more skilled.

It does have a merit and I do believe that Epic added some tweaks to their engine the unreal 3 ( god I hate it) so they can optimize their own games only, so other developers who sign with Epic to use their engine wouldn't get the same result of quality as gears of war had. This is why developers who signed with Epic to use the enging and made games that looked mediocre in terms of graphics and god this generation is full of games that were used by this engine. All unreal 3 engine games look totally crap except those designed by Epic such as gears of war. I only liked exclusive games like metal gear solid or uncharted because they have amazing graphics developed by using exclusive or different engines.
