Minecraft dev wants to settle lawsuit with Quake 3

Markus "Notch" Persson challenges Bethesda to a team deathmatch competition, promises to let Skyrim publisher approve a new name for Scrolls if he loses.

Lawsuit settlement negotiation may soon become a spectator sport. In response to a trademark complaint from Bethesda Softworks, Minecraft creator Notch is suggesting an unorthodox way of settling the dispute.

In a post on his blog, Markus "Notch" Persson has proposed a decisive game of Quake 3 to put the litigation to rest.

"I challenge Bethesda to a game of Quake 3," Persson said. "Three of our best warriors against three of your best warriors. We select one level, you select the other, we randomize the order. 20 minute matches, highest total frag count per team across both levels wins."

If Persson's team wins, The Elder Scrolls developer would have to drop its lawsuit claiming that the indie developer's next game, Scrolls, infringes on its own trademark. If Bethesda wins, Persson would agree to change the name of Scrolls to a Bethesda-approved title. In either case, Persson would be willing to put a disclaimer in his game noting that it is not related to The Elder Scrolls series in any way.

"I am serious, by the way," added Persson.

As of press time, Bethesda had not returned GameSpot's request for comment.

Funny, that was how a clan mate and I solved a dispute over our game tag during the Dreamcast days. Winner of the match got to keep the name "Beast" to prevent confusion and as you can see I lost but came up with a better name in the long run. However Notch may be in for a challenge if the gauntlet is picked up. Since Bethesda bought id last year, they can throw some of those guys into the match and I am sure many of them are VERY good at the game.

Doesn't bethesda own ID now, including some of the guys who made quake 3. Not too smart notch should've challenged them to counterstrike or something.

Notch is an interesting man. He was very cool about this whole thing, and willing to compromise reasonably. THIS, on the other hand, is just pure awesome. I hope they except and he livestreams it. I'll be standing on my desk chair cheering for him!

I really don't see how you can sue someone for using a word from the English language which just so happens to be a part of a title of one of your games... What's next? Activision going to sue everyone with the word "of" in their games?

Bethesda are too much "corporation" and not enough "gaming" to ever agree to this. Also, everyone take 5 minutes to search a list of games or movies on the internet and check a few names there. If a claim like this one from Bethesda would be legit, it would be impossible to release anything in this day and age.

I still can't believe bethesda is going after him for "Scrolls".. It just goes to show, how bu$ine$$ minded the gaming industry has become. Things like minecraft go to show there are innovative ideas still coming out.. then a publishing giant decides to sue them, for shame. Obviously game companies are companies none the less and deserve to make money for their hard work. But this lawsuit?? What is the point of this lawsuit? are they this worried that Skyrim wont live up to it's hype? what is with this? They had to know it would look HORRIBLE on them for doing this... maybe all of it was just a publicity stunt, seems unreal with how it is going. But honestly? Quake 3 match to settle THIS lawsuit? well that is one of the coolest things ive ever heard of :):):)

We should solve all legal disputes in the gaming industry with a 3 stage competition. ROUND 1: Deathmatch (Quake, COD, Halo whatevr). ROUND 2: Racing (Mario Kart..... awww yea). ROUND 3: Fighting (SF4, Calamity Trigger etc) I wish life worked like that lol

@chevydriver1123 I agree where you said that GAMERS should solve their disputes this way...and I disagree with most of the people here who say that all the conflicts in the world should be resolved like this...like @cayne_phoenix It wouldn't be paradise because then all people would try to get better at games just to profit from a thing like this! It would probably be Hell! @Kevz0 Try to be rational! I mean in this context and lawsuit this idea is probably one of the best! But if something bigger would be at stake than a word? Would that be the best way to solve a dispute like that than a fair lawsuit? I'm just saying! In this case this is an interesting idea...but in general would suck! This is the way that only gamers should resolve their disputes!

these events definetly backfired on Bethesda's lawyers, first they make the company look bad and now they wont make any money off this. Ha. and Bethesda wont turn this down as they wont want to and if they did it would make them look bad. i no some lawyers who soon wont have a job

This lawsuit is ridiculous to begin. "Scrolls?" Really? It's a single word, used to describe letters written on paper/parchment. Bethesda are being jerks here.

There is the rather asinine argument one can make for Bethesda that "Scrolls" is a casual, brief way to describe their property. By that logic, however, Coca-Cola should file suit every time someone on television says "coke" when referring to Cocaine or powdered coal, and they've even trademarked the word "Coke". I don't know anything about Notch's creation, but as long as they're not similar creations (i.e. more similar than that they're both games), then Bethesda doesn't have a leg to stand on.

Watch Bethesda wuss out from this challenge of video games. I love Bethesda....well, LOVED Bethesda, until they showed their true colors with this stupid lawsuit.
