Minecraft dev wants to settle lawsuit with Quake 3

Markus "Notch" Persson challenges Bethesda to a team deathmatch competition, promises to let Skyrim publisher approve a new name for Scrolls if he loses.

Lawsuit settlement negotiation may soon become a spectator sport. In response to a trademark complaint from Bethesda Softworks, Minecraft creator Notch is suggesting an unorthodox way of settling the dispute.

In a post on his blog, Markus "Notch" Persson has proposed a decisive game of Quake 3 to put the litigation to rest.

"I challenge Bethesda to a game of Quake 3," Persson said. "Three of our best warriors against three of your best warriors. We select one level, you select the other, we randomize the order. 20 minute matches, highest total frag count per team across both levels wins."

If Persson's team wins, The Elder Scrolls developer would have to drop its lawsuit claiming that the indie developer's next game, Scrolls, infringes on its own trademark. If Bethesda wins, Persson would agree to change the name of Scrolls to a Bethesda-approved title. In either case, Persson would be willing to put a disclaimer in his game noting that it is not related to The Elder Scrolls series in any way.

"I am serious, by the way," added Persson.

As of press time, Bethesda had not returned GameSpot's request for comment.

Original, entertaining, fresh idea. Kudos to Persson for suggesting it, though I can't imagine a company as stuffy (i.e. pent-up over itself) as Bethesda is would ever agree. Perhaps ten years ago when they cared more about making good games than the bottom line..

I don't play or really care for Minecraft, but for offering to settle a legal dispute in a video game duel...Mr. Persson has my eternal respect. In a world of legal BS and mindraping procedures, where numbers and insults are thrown back and forth, he challenged the company to a friendly duel at their respective field - and agreed to add a disclaimer to his game, even if he wins. That's A+ material.

I see plenty of people complaining about how they lost all respect for Bethesda because of this, etc etc. People need to realize that Bethesda is a company, and the developers that make the games you love have nothing to do with the lawyers of Bethesda's legal team. Those lawyers are responsible for all legal matters, and are most likely the ones that decided to go ahead with the lawsuit. Before you all go shouting "Not buying Skyrim now!" (which, looking at what we've been shown so far, looks like a pretty bad idea), at least entertain the thought that the developers might not have anything to do with this. And even in the event they want to take up on Notch's offer, they might not be able to because of their legal team, not because they would not want to.

Yeah, bad move from them before Skyrim... You don't mess with a guy with so much popularity. I hope they accept it and lose. It's the only honorable thing left to do. Otherwise, people will just bash them to death for picking on the indie.

So, in other words, Notch is willing to not only soften the negative PR with a Quake deathmatch, but he's also going to mention Elder Scrolls in the game (free advertising). If Bethesda doesn't drop the lawsuit after this, they will lose all respect I have for them.

@SDBusDriver1979 sure it's a little childish, but it's also a PR stunt that will benefit both sides. The game Scrolls (whether it will be the final name or not) would become famous for the fact that its name was decided over a match of Quake 3.

he better be sure to have a packet of paperwork for them to sign if this is the way that Persson wants to settle this, b/c if Bethesda loses, they don't have to pull out of the lawsuit. It might not be very sportsmanship if they did this, but playing a game online to decide who's the winner, won't show well in court as legit proof that he won the settlement...

Well, if you have a ridiculous legal accusation, it seems approprate that it be settled in a ridiculous fashion. I naturally believe that Mr. Persson is in the right here and that Bethesda's legal attempt has no basis, but this would be worth it just to call Bethesda out on how ridiculous this whole thing is.

This should be PURE WIN for both parties. Not only will it garner interest on both developers, but they can make this into an event. Neither side will lose if this is done correctly. Whats really at stake here is just a NAME. If Bethesda accepts, it will turn a possible PR nightmare into something fun. Cause honestly... suing someone because their title contains a word that is being used in your titles is REDICULOUS. If Bethesda wins, I assume this opens the door for someone suing for infringement on the use of "THE" in their future games.
