Activision countersues Worlds Inc.

Call of Duty publisher files patent infringement lawsuit against Worlds Inc. and Worlds Online Inc. over "Worlds Player" software.

Activision Publishing has countersued Worlds Inc. and Worlds Online Inc. months after the latter claimed the Call of Duty publisher infringed on a patent it holds for online worlds.

Activision's countersuit claims that Worlds has infringed, and continues to infringe, U.S. Patent No. 6,014,145 and U.S. Patent No. 5,883,628, which relate to 3D worlds.

Patent No. 6,014,145 reads, "Navigation with optimum viewpoints in three-dimensional workspace interactive displays having three-dimensional objects with collision barriers," while Patent No. 5,883,628 covers "Climability: property for objects in 3-D virtual environments."

The contested product is Worlds Inc. software called "Worlds Player," which is a 3D content and technology platform.

Worlds Inc. originally filed a patent infringement lawsuit against Activision Blizzard, Blizzard Entertainment, and Activision Publishing on March 30, 2012.

"Technologies created by Worlds have helped the businesses of virtual worlds gaming and the sale of virtual goods to grow into a multi-billion dollar industry," Worlds Inc. CEO Thom Kidrin said at the time. "While we are pleased to see that the gaming industry and its rapidly growing customer base have enthusiastically embraced our patented technologies, we deserve fair compensation for their use."

That lawsuit, filed in Massachusetts, is pending.

patents are bullshit and only used to ensure monopolies and hopes of being able to abuse loopholes in outdated laws. It used to be to protect inventors from having their stuff stolen by big companies, but this has turned into a circus for some time now and laws need to be seriously updated to stop this abuse from going on with PATENT LAWSUITS.

Gosh the patent system is so outdated when it allows situations like this. I mean, even the original suit and the counter thereafter. Its hard to innovate when people have rights to "double-click" and things like this.

ahhh, patent trolls at their finest. This has been going on for quite some time, yet there's been almost no laws to curb this act. Any attempts to try and stop patent trolls have either failed or have had an extremely low success rate...

Think you have an uphill struggle on your hands converting the record breaking pre orders. Would be nice to see them do something different but will never happen while Ted from accounts who only buys 2 games a year one of which is the new cod and another is the new FIFA. Cod was good starting to get a bi old now hopefully ghosts will shine a bit more seeing as its on the new consoles but we'll see

@blackothh @Darthexodus Thats an opinion sure, while I have no love for CoD games and proudly have not bought MW3 to this date (or any other CoD after MW2), effectively breaking a trilogy (voting with my wallet) is a challenge to me, I wonder what else can you do with an FPS game? I think the genre is stale and as easy to maneuver as a brick during mid-throw. I would criticize CoD a lot, personally I prefer Battlefield as it gives me more strategic options, but aside from the scale, the game structure is rather similar to one another.

What type of innovation are you looking for? (honest question).

@Hekteur @Zerot Well, we can always make a game where we can trash Activision, EA, Microsoft or Sony, just a fan service you know? =)

I mean this is what we do in my country, you see, soccer is a pretty important/religious even here. So when an opposing team wins in real life, some dudes that had nothing better to do would angrily play FIFA and chose their team against the opponent and then change the real life result in the virtual environment to their favor.

While this is pretty stupid/simple, its a fantastic stress relief if you care enough about a certain topic. Heck, even Activision could get a kudos if they had a secret map in CoD that took place in their office, make it something like the airport level in MW2, make the board of directors an end-level target or something. I mean, if they did a level were killing 100s of innocent bystanders is ok, then I am sure they wouldn't mind such a fictional map on their own environment, right?

Me? I care nothing for soccer (must be the only one in my country, lol) I rather play a round of Dynasty Warriors when angry and beat the crap of everybody there. I feel so much better afterwards.

Activision is actually a good guy here. Worlds Inc. is clearly a patent troll. Thay patent things for the sole purpose of using them to sue other companies. So Activision counter-suing is basically them saying, "If you really want to try to enforce a stupid patent for unbelievably common interaction, you go right ahead, because we've got your number too." Maybe it'll be enough of a threat to get Worlds to shut up permanently.

What the actual **** is going on here?

We have two companies suing each other with software patents for designs that are ridiculously obvious and have been around long before either of these patents were filed.

The USA truly has the dumbest laws in this area... ever.

@Kunasha Patents are a lot more complicated then that and you shouldn't guess a patent based on its name alone. A patent is even more complicated than an insurance contract. It might be as complicated and specific as a very precise functionality implemented in camera control or in computer controlled camera. If I'm correct, it's possible for the public to consult any documented registered patents so go ahead! Take one and try to decipher what it is exactly.

@vadagar1 You don't want to live in a world where the average Joe can't make a single dime over one of his creation just because all of the big companies can just rapidly mass product any interesting discovery. The patent laws are trying to protect whoever make a relevant discovery from getting his idea stolent. It's not as simple as just "sharing stuff".

Reminds me of the lawsuit that Newegg won earlier this year against patent troll Soverain over its use of an online shopping cart. The court ruled that Soverain's claims were "invalid for obviousness".

Yes, "obviousness" is a serious matter in the patent world.
