Ladies and Gents,

nVidia has finally run out of options and has decided to settle the class action lawsuit for lying about it's full 4GB specs of the GTX 970. For those who brought GTX 970 you can now claim $30 which nVidia will be forced to hand out.

You can submit for your refund on the website below:

Note: You have until November 30, 2016 to file a claim, or you can opt out by November 8, 2016 and retain your rights to sue Nvidia. You also have until November 8, 2016 to object or comment on the proposed settlement. If you do nothing you give up your right to the proposed settlement along with your right to sue Nvidia.

So, if I were a GTX 970 owner or know someone who owns a GTX 970 I would tell them to submit it ASAP.

At least you guys are lucky and getting some money I brought an expensive 17" Gaming Laptop with a nVidia Gaming GPU and it died on me because of defective design on the manufacturing of the GPU, which nVidia lied about and tried to cover it up till they lost like they did here in a class action lawsuit. Too bad I got $0 out of it because the lawsuit didn't include Botique Gaming Laptop makers like Alienware.

It would have been quite pissed if I bought a 400$ card and find out later they nerfed 1/8 of my vram.

@Xtasy26 Do you only come here to make threads involving bad things about NVIDIA? Why aren't you talking about the fact Pascal has been running rampant for months and AMD isn't releasing anything to force competition in the higher-end bracket?

I live in Canada, but even if I didn't, I don't care that much. In all honesty, my 970 has been a solid card.

1080p or 1440p? I have a 1440p screen and it struggles a bit at that resolution on some games.

only for USA. damn ye nvidia

so far though the only game i've hit 4gb of usage that i have played is Rise of Tomb Raider with the textures max'd at 1080pee. If i turn them down 1 notch the memory usage is around 3gb and runs fine. I almost hit 3.4 gb usage on GTA 5 with things max'd.

Still though, that 30 dollars could have changed my life.

What the hell? I was only posting facts and informing Gamers who got screwed. What the hell does this have to do with Pascal? (and for the record I did talk about it on the PC Hardware Forum when it was announced that Vega was going to be delayed). Stop deflecting and trying to change the subject.

This also has to do with the fact that this is not the first time nVidia has screwed Gamers, as I stated in my OP where I lost an expensive 17" Gaming Laptop because it had those defective nVidia Gaming GPUs. If someone would have informed me that there was a class action lawsuit against nVidia due to those defective Gaming GPUs that they were putting in laptops, I would have contacted the law firm and tried to include my Gaming Laptop maker to be on the lists to be compensated.

I am doing a service to the PC Gaming community here in Gamespot and as it turns out some people didn't know about it. Unlike you, I am actually doing something to help fellow Gamers who got screwed by nVidia.

I don't regret paying what i did for my 970, and i'm pretty sure my next card will be nvidia as well

@undeadgoon: I used to own one and ran into VRAM problems fairly frequently at 1440p. Switched to a pair of 980's which have the same amount of VRAM and never got VRAM issues again except for DOOM and Rise of the Tomb Raider which require 5GB+ of VRAM. Good thing I sold my 970.

Filled out the form maybe...a month ago, it feels like. I get my $60 back! Nvidia...you lying sob's!

I've also gotten 2 980 ti's since then, as well as 2 1070's. One day...I hope AMD is competitive again (haven't bought since...I think it was 700 series? Long time ago...can't remember)

No, it's not being an idiot. If I buy a car that states that it has 550 Horse power and I buy that car I want those extra 50 horse power not the 500 horse power, if that was the case, people may have chose a different car to go with if they knew they weren't getting the horsepower they thought they got. People may have brought R9 290 or R9 290X for example if they had know about the 3.5GB issues. It's called justice.

And as it turns out, 3.5GB limit is being easily hit in some games now.
