Kyle Richards, 21, claims that he is being subjected to "cruel and unusual punishment" because the in which is is being held does not allow pornographic materials.Although he is being held in the Macomb County Jail, which is run by the county, he has named the state of Michigan and Gov. Rick Snyder in his lawsuit.An inmate in a Michigan jail, who has entered a guilty plea to bank robbery, is suing the governor and the state over his lack of access to porn.Richards also claims televisions, radios and game systems should be allowed in the jail.

"Such living conditions have been used as a method of 'psychological warfare' against prisoners, in order to both destroy the morale of inmates and break the spirit of individuals,"The Detroit Newsreported that he stated in his five-page lawsuit.Richards, whose criminal record includes convictions for assault and battery and assault of a prison employee, has filed several complaints in several court, and judges have dismissed at least three as frivolous. Because he has had other lawsuits labelled frivolous, a judge can dismiss any others he files.Richards says he is suffering from chronic masturbation syndrome and sexual discomfort.

"Sexual deprivation has been used against plaintiff in a way as to both sexually frustrate the plaintiff, deprive the plaintiff of any sort of sexual gratification, and deny the plaintiff his right to sexual reproduction,"Gawker quoted him as saying in the lawsuit.The Macomb Dailyreported that Richards is an admitted pedophile, and quoted Macomb County Sheriff Anthony Wickersham as saying: "He's not going to get any of those materials from us. As long as I've been with the sheriff's department we haven't ever allowed porno in the jail. It's against our rules, it's that simple."

His poor mother - not only does she have to concede his bad behaviour to the local community, she now has the added humilation of her son making a public announcment that he finds life tough without some kind of w*** aid.

What ever happened to just using the imagination? Surely years of porn consumpmtion should all add up to a fairly decent sized w*** bank in his head for starters.

You can't vote in jail either. But I don't see him suing over that. It could be worse, in some countries porn is completely outlawed. In some Middle Eastern countries they treat regular porn like we treat child porn over here.

But it doesn't surprise me that the suit could go forward. Even though the inmate wouldn't be in this situation if he didn't commit the crime.

I hope this is one of those times where a judge uses common sense and tells the guy to stop wasting peoples time and tells him that if he wanted access to porn maybe he shouldn't have robbed a bank and instead gottebn a job, bought a computer and internet connection and had access to all the porn he wanted...

If it's one of those cases where lawyers try to exploit some insignificant and semantic loophole in the law and the judge actually falls for it then the entire United States should just implode. The law should be there to protect people, not allow convicted criminals to make asinine cases in an attempt to exploit legal loopholes especialyl when common sense fills in that hole.

Jeez what kind of luxurious lifestyle affords people such choices. 'Oh no - one cannot when one has no visual stimuli'.

Back in my day I had to draw pictures of stick men/women in compromising positions to get me going. Once I got my weekly 1 groat in pocket money I would invest in some pipe cleaners and re-enact the entire karma sutra.

I don't know where you read that you forfeit your luxury to porn when you commit a crime. I can kinda understand where the guy is coming from because sexual stimulation is needed and wanted by the very fabric of the human rage. To take that away might be pushing past the line of luxury and into the line of need which would be cruel and unusual punishment.

It basically amounts to someone's interpretation of morality being imposed on inmates, rather than just banning something for practical reasons (like weapons). It actually seems like it would make a lot of sense to allow it, because it would probably reduce the prison rape problem.

He is being PUNISHED for being unable to operate within the bounds of the law and in a manner that benefits society. It's not "cruel" or "unusual". He is in prison without luxuries because, yes, he is being punished. If he wants to masturbate he can use his imagination.

I see it more like prisoners being fed bland food, like oatmeal and bread and water. So long as they aren't starving or suffering from malnutition they have no right to demand better tasting food. They are being punished. Why should prisoners have access to luxuries such as great tasting food, TV's, computers and the internet when they are supposed to be being punished for being unable to operate in society?

You don't reward a naughty child with lollies. You send them to their room.

lol the idea of easy to come by naked women seems far more like a luxery rather than any sort of cruel and unusual punishment due to a lack of it.

People sneak cellphones, chocolates, radios, among other stuff in jail I think that if he asked around he could get pornographic material. Easier than sueing the state.
