I did also hear that Nolan just doesn't want to use Penguin. True he's nothing unusal, but maybe he just shares my opinion that he's also so lame. His tradmark being umbrellas and a boird fetish. Glad to hear he won't be in any upcoming movies. Harley Quinn I can't see happening as she's too comical, whereas Joker was a real menacing psychotic terror. I can't see this version taking on a side kick.
Of course many other well knowns are ruled out as well for being too far in the realm of the unusual and beyond human - Manbat, Clayface, Sub Zero, Killer Croc. Though I think there would be a great deal of possibility with Clayface, where he uses his shapeshifting abilities to create tremendous discord in Gotham - impersonating Batman, Gordon, the mayor, and who ever else, but espcially Batman, people thinking they witnessed him commiting crimes.
Poison Ivy - where did anybody get the idea that she's interested in Robin? All my reading experience has shown that she's always tried to enslave Batman with her mind toxins, to make him her personal soldier. And it's with her seduction talents I think she makes for a great villain. Especially casting Scarlet Johansson.
I very much want to see Riddler in an upcoming movie, but to be done right and not the way Jim Carrey or Frank Gorshin did it. I think Wentworth Miller would be spot on for the role. And while it is agreed that Riddler is more high profile, Dr Strange really is the more appropriate choice just specifically for the plot idea I had a few posts back. I think Riddler would be better suited for some other kind of story. This goes to say that I really really hope the next movie isn't the last. There's more than enough material to keep Batman going on beyond just the prepackaged triolgy format.
And Nolan really said he didn't want to touch Catwoman?? Really???? Not even if the sooooo hot Kate Beckinsale got into that snug form fitting bodysuit? But seriously, the unique mutual attraction and adversarial protagonist/antagonist relationship dynamic they have is just TOO good not to use. Especially given how Nolan could work that so much better than any of the past directors. Ohhhh Nolan, how could you pass this up???
I should add, much of what I said here ties into the post where I initiated the Next Villain subject of this topic. Hope y'all read that, (it's 2 pages back if you view 20 ppp) and I left this open for everybody to pitch in their casting ideas for the various villains. So lets hear em :)

While I want Riddler, Nolan wants to stay faithful to the Dark Knight comics, and Riddler isn't in them I don't think.
