I am currently considering which one to get.

Are their any major differences in the instruments in Rock Band 1 and 2?

Am I able to transfer the songs from rock band 1 to rock band 2?

Is their any warrenty on the instruments?

There are not major differences in the instruments but the RB2 instruments are a whole lot better than number 1. Yes you can transfer the songs, but you can only do it once per disk. So dont think you can just buy a used RB disc transfer the songs then return it. As for the warranty I am pretty sure there is a 1 year warranty on the instruments and such.
