I dont think I would chance it. Bite the bullet and exchange the elite for one in a better box that looks like it is still officially sealed. I had the same issue with my premium when I bought it, but I was too excited to use the 360 that I ignored the warnings signs liked you mentioned and played on it anyway. Needless to say, a had some problems from the start, and a few months later...bam, I got the RROD.
Take the time to return it now, I think it will be worth it in the long run for such an expensive and important(at least to a gamer) investment.
the box seems like it fell a few times...the corners of the box seems kinda smash...and the box was aready open cause i can tell the orginal sticker that keeps the box from opening was cut..and they just added another clear tape cover it....i've only power it up(seems find)...havn't hooked it to a tv yet.....ZnLRyDa

GOOD LORD, TAKE IT BACK!!!! Don't even bother hooking it up. It's better to be safe than sorry.
didn't notice until i left the store...was like f*** it...got the 1 year store warrenty...and pluse they were saying something about u can exchange it for a new one whenever u want...saying if u break it yourself or watever...was like ok..i guess..ZnLRyDa
Best Buy is pretty good about their replacement plan. More or less all you have to do is say it doesnt work and they say okay and you replace whatevers broken.
I replaced my old Premium 360 with an Elite yesterday for $50. And you better believe I spent the $80 extra for a replacement plan on the Elite in the event HD DVD catches on and we see an XBOX with an HD DVD drive...

How did you exchange it? Did you already have a replacement plan on your premium? I'd be interested in exchanging for an elite for only 50 bucksi've hade it for like almost 2 weeks nows...havn't touch it since...everything else is still baged up and orginally tape up...besides the console and the power adapter...but aite...well do...i just hope they (the store) complain about there nothing wrong with it....ZnLRyDa

Uh, yeah, that would be cause enough for me. It shouldn't be openend and the box shouldn't be damaged, especially not for $400+. But hey, if you feel comfortable with it, then keep it. You do have a year warranty. Your call.
Edit: and yeah, if the box if pretty badly damaged then that means it had to take a pretty hard fall or jolt. You really don't know what kind of internal damage the HDD, DVD or Motherboard might have. Could fail after a week or it could work like a champ for years.
