40 is pretty old so you might be taking a risk if it is used. I had a 60 gig and the blu-ray went up on me. And I took good care of it. Heck You can almost get a 120 gig for that price. True you wont get the 5 games. But used PS3 games are not really that expensive. Especially on e-bay. You can get some good ones for $20.
Thinking is overrated! :P
As said above, you could (and probably should) just buy a brand new 120GB. Guaranteed to be fault free and you'll be covered by a warranty in the unlikely event something does go wrong.
I would suggest that you at least get an 80GB if you're going to be cheap. Or go on the Sony website and get a Sony Refurb. That's what I got and I have been playing on since Dec 26 2009 it comes with all the warranties a new one would have. The 40GB doesn't have WiFi which could be a big draw back in the future I guess.

it depends on what your looking for really, youll be good with the 40gb because it has the ps2 emulation software (i think might wanna look it up first) but there again low memory. but luckily for us ps3 owners we can upgrade our hardrives :)
