If you bought your old mp3's through a music service other then iTunes, you will not be able to put them onto your iPod Touch because they will have different DRM then Apple's Fairplay. However, if those songs were not obtained from a music service, you could just copy away.
Also, forgot to mention, but if you bought them from Amazon's music store, which I would highly recomment next time you're shopping online, you're fine. They don't have any DRM on them, and they are at a slightly higher bitrate then iTunes which means better sound quality on your end.
I got them from my friends and I think that they got them from wall mart does that count as a music service
I do believe Walmart has DRM-free music so you should be OK, but don't hold me to that.
The new touch has a new bezel, new aesthetics on the back, and the volume keys are physically stationary on the side.
Also, don't get your hopes up with the internal speaker; I'm sure its just a plain mono speaker. I hear horrible things about the sound quality and, to quote Mr. Jobs, "This isn't for audiophiles."
