Link: Breaking: Utah Gov. Tells 1360 Legally Married Same-Sex Couples Their Unions Are Invalid

Republican Governor Gary Herbert has just announced that the state of Utah will not recognize the legal marriages of 1360 same-sex couples until the courts force him to do so. Gov. Herbert, has been working angrily and tirelessly to convince the courts to stay a federal judge’s ruling last month — which found the state’s ban on same-sex marriage unconstitutional. He and his new Attorney general succeeded on Monday, when the Supreme Court placed a hold on the ruling, and denying any future same-sex weddings until the Circuit Court ruled on the actual case.

Governor Herbert just issued a memo directing all state agencies to not recognize these marriages that were performed legally under current existing law, between December 20 and January 5. No same-sex marriages performed in state or out of state will be recognized, Governor Herbert has directed.

“After the district court decision was issued on Friday, December 20th, some same-sex couples availed themselves of the opportunity to marry and to the status granted by the state to married persons,” the Governor’s memo reads.

“With the district court injunction now stayed, the original laws governing marriage inUtah return to effect pending final resolution by the courts. It is important to understand that those laws include not only a prohibition of performing same-sex marriages but also recognizing same-sex marriages. Based on counsel from the Attorney General’s Office regarding the Supreme Court decision, state recognition of same-sex marital status is ON HOLD until further notice.”

Not being a lawyer, I really have no idea. My thought was just that if they put a hold on forcing the state to recognize/allow same sex marriages, then they wouldn't have to recognize existing them (in addition to not having to allow new ones).

It's a dyck move but to be fair he represents the people of his state.. and I'm sure the vast majority of Utah backs this...until it's settled in the courts oh well...

Unfortunately, I believe that only applies to criminal laws not civil matters. They would have to make a very convincing argument outlining this as some sort of punishment in order for the ex post facto clause to apply (or so I believe)

Imagine if other religious people tried to make things illegal based on what they believe.
Photo: Utah is going through a back-and-forth on treating all citizens equally under the law. We hope the US Constitution is honored here. Objections to the "lifestyles" of others are something almost none of us can help having, but they are never grounds for subverting others' rights.

Nope. It going to be Texas.

Texas has some surprisingly gay-friendly areas. Houston, for example, is up there with Atlanta as one of the Southern gay Meccas. I wouldn't be surprised if they got to it before us.

Florida, however, is horribly gerrymandered and run by teahadists, except for a few cities (Tampa). As long as our legislature is the Rick Scott variety, we'll never see progress unless forced.

@Makhaidos: Perhaps, but the political mentality in Texas is extremely right-winged and traditional. I spent 9 months there and I couldn't wait to leave. Maybe it's because of where I spent my time.

I don't understand why the U.S. Supreme Court doesn't finally settle this. It seems a bit ridiculous that the Supreme Court has yet to say anything about something that's been a big issue for a while now.

Update to the update: a bill has been proposed (by a Republican, obviously) that would limit the federal government to recognizing gay marriages only in the seventeen states in which gay marriage is legal.

Nevermind that this exact thing was just ruled unconstitutional by the Supreme Court. These hicks just don't know when to quit, do they?

Well, it's kind of insensitive to not consider how same-sex couples feel about this. I mean, it's kind of dehumanizing to be given rights that you fought hard for, only to have them stripped away because someone just had to hold on to their bigoted worldview in a vain attempt to preserve its relevance in an increasingly social world.
