The second hand smoke from their cigs cause a person to get cancer over the years and they die from the cancer?

There have been many situations where a spouces smoking has caused there partner to get cancer and die, should they be lieable for that death and charged with either manslaughter or second degree murder?

Smokers say it's my life choice, but what happens when that choice starts harming others, then is it still there choice to make?

What do you think?
What would your reaction be if the law was changed to charge people in this event? (If you are a smoker mainly)

Wouldnt be charged with murder, more like involuntary mansluaghter or something.

And no, its legal to smoke, the non smoker should reconize the health risks involved in second hand smoke and choose to move away from the harmful smoke.

:roll: Yeah, like you're able to do that when you're a child and your mother smokes. Cannot move when you're a teenager and your family smokes either. How can one move away from the harmful smoke? Is it their fault then?

It should be illegal to smoke around children.. but how they can control that I have no idea. But anyone no matter how old someone is.. if a smoker has anyone living with them that doesn't smoke should go outside!

According to those two studies, the risk seems relatively low. A relative risk of around two percent when exposed to approx twenty cigarettes a day.

If that were the law we could then use the same law to charge any smoke-emitting factory or coal power plant with murder. So no, it'll never happen.

If they would be charged, so should every other place that emmits smoke.

I don't remember the last time I've seen someone smoke though. I'm glad smoking isn't allowed in public areas in Ohio.

Not at all. lung cancer can happen to people who live in the jungle and are far removed from smokers all their lives. Smoking for lung cancer is an INUS condition.

How the hell would you prove that that one specific smoker killed that one specific person with their specific second hand smoke? In short, no.

No. This whole idea is stupid.

Second-hand smoking and getting cancer isn't the same as shooting someone. What if someone develops cancer from breathing in too much car exhaust.

Smoking, whether desireable or not, is just another one of the elements around us on this planet Earth.

I thought this topic was going to say:

"Should smokers be charged with murder if their cigarette causes a building to burn with victims inside?"

THIS idea, though, is rather lame.

And everyone saying, "it's your choice whether you want to stand next to a smoker," I don't smoke, but a few good friends I have do, and I am not going to isolate them because of their habit or be a prick and nag them about it, even if I don't approve of it.

No. That would be ridiculous. Air pollution/smog inhalation from living in a major city like New York can cause lung cancer too. The next time someone gets cancer from this, should we charge every single motorist/combuster of fossil fuels in New York with murder too?

I think everyone should smoke 2 packs a day so that they could understand how much willpower it takes to keep puffing away at those smokey heat sticks!

Radon causes cancer, lets ban it as well.

In fact, cars cause deaths all the time so lets just ban those too.

And jets crash killing people. Ban them as well.

People kill each other all the time. Ban people.
