Maybe because the didn't have one entire nation but many different nations.

That is factually accurate, but I don't see how it has anything to do with the topic at hand. If we regard the people who settled in the territory of each nation individually, the situation is identical.

That depends. If we divvy up the country into tribal allocations....there would be some land not utilized. Correct? So technically it would be up for grabs to whomever settled it.

Jokiness missed then, my apologies. By the way, I'm open to immigration reform, but I do want it do be done in a considered way consistent with the laws and fundamental principles that have governed the USA from its founding.

Well I was referring to his comment that anyone BUT Native Americans....we need a shorter descriptor to type....was an immigrant. Initially...they were as well. Anyway in regard to this topic.....unless and until a society forms and creates immigration laws then you can't enter illegally. However, once that is done...there comes two forms of immigration. Legal and illegal. Which is what we have now...but did not have then.

Related though. Why is it so hard to get here legally when there is clearly a very high demand for immigrants to do work ranging from ditch digging to genetic research? The market says let them in (as does American history).

2. I find the the whole concept of changing the Constitution/ignoring it in this case utter bull ****.

3. With that said, immigration needs reform bad. The whole issue is starting to get out of control, especially when anchor children are thrown into the mix.

We need reform bad, and its needs to be at the front of national issues. Its ben long over do for over a decade.

How exactly would this affect people already born? Would it only affect people born after the date this was made law or will we see 28 year olds with a job, wife and kids, and who have lived here all their life get deported because they had illegal parents?

You're misunderstanding the proposal. I did at first look and thought it was Arizona trying to deny citizenship to children of illegal immigrants born within it's state borders. It's actually Congressmen from Arizona trying to introduce a Federal bill that would change it for the whole country if passed. I seriously doubt it would get the votes to pass considering how much support the DREAM Act had, which would have made a path to citizenship to people who were bought here illegally after they were born.

Challenging birthright citizenship is a waste of time. Its written into the constitution and would require amending it. Its far easier to make it impossible for illegal immigrants to find an employer willing to hire them. If they can't find a job then they won't even bother coming. Take it a step further and deny illegal immigrants access to nearly every thing the American tax payer pays into and that will solve the problem completely.

No need to amend the constitution,militarize the border or build a huge fence.

I don't think so.. Its not the children's fault for something they had no control over.. I would rather they become American citizens than possibly shipped off to a poverty stricken dangerous place.. I just find it immoral that we could allow that.sSubZerOo

This, and they typically spend a good deal of their lives here. Some of them move here at a point they probably can't remember and have spent all of their childhood here. They have more of a connection to America than they do to a place they might not even remember being in and didn't grow up in.

Actually, men get more conservative with age, women get more liberal. And I don't think anything happened, the number of people on both sides of the issue is probably about the same as it has ever been. I think the difference is that the swing voters are still sticking to an illusion of bipartisanship in politics whereas the Republican Party has firmly said that its number one goal is to push their agenda no matter what. I don't think it's a matter of voters actually wanting these types of policies going into place, but a matter of voters supporting Republicans who are going to put these policies into place regardless of voter opinion.

Good, a free pass to become a US citizen is stupid. I have cousins from phillippines that takes 10 years for them to process while someone can simply walk over and have a kid is fail.

Yeah, I'm not sure how Arizona feels that it can decree who is a US citizen

To be fair, I think they're using this to just force a case to the courts in the hope it'll reach the appropriate authority (Fed circuit/SC/whatever) so they can have a chance at a ruling in their favour. I could be wrong though, and it wouldn't surprise me if I end up being wrong.

Actually, this is already what the law says. The term "anchor baby" is technically incorrect because having a child in the US doesn't automatically secure you a spot in the US if you're here illegally. Neither does marrying a US citizen. A child can petition you for a visa but they have to wait until they're at least 21 first to do it. I've heard of people who were married to citizens and had American-born children who were deported for being here illegally. They can always apply for humanitarian parole but it's probably going to be denied 99% of the time unless they can prove they'll be in great unavoidable danger if they go home (they're marked by some drug cartel for assassination as soon as they cross back into Mexico for example). The only way I know of where an illegal immigrant can stay and apply for legal status is if they have an immediate family member that's in the military. They can't join themselves because you need at least a Green Card to enlist but immigration started granting parole on a case by case basis to people who were married to servicemembers or had an immediate family member serving starting last summer (don't know if they're still doing it now or if they stopped).

im hispanic, and i cant tell you how much my family have to put up with stupid Hispanic ( lets face it people most of the people here in the US illegally is Hispanic /latino) gang bangers, and low life chunties. and other thing i cant stand ok fine teach your kids Spanish so he/she can have it as a second language, but that doesnt mean to make you kid born in the US to speak, write, read, and understand only Spanish, that makes me sick

My question is how does one then become a citizen? The wording of the law may cause confusion too, does this law only apply to people who are born from undocumented immigrants? What about families with mixed statues (one a citizen, the other undocumented), or does this law apply to every child. If it does apply to everyone once again how do you apply for citizenship? Wouldn't this clog up the process for becoming a citizen. If this law is enacted, wouldn't it be entrapment somewhat? I mean it would be similar to the marajuana law passed long ago (In order to sell marajuana you have to have a liscense but in order to get a liscenes you must have marajuana) just in this case in order to become a citizen you would have to apply to become one but you would still be living here illegally and possibly your parents too, meaning you could end up being deported, arrested, jailed, fined or all of the above depending on how the law is worded. I think taking away birthright citizenship wouldn't have any positive effect for the United States and it would still fail to deal with the estimated 13 million undocumented people living in this country. In my humble opinion a path to citizenship needs to be created but Congress at present would never go for that unfortunately.

It may be what the law says, but they sure as hell don't enforce it. So, I still consider it an issue.

People do a lot of immoral things simply because doing the right thing will do more harm than good. If you keep doing the nice thing eventually the U.S will be a poverty stricken dangerous place.

Blame the poloticians. Everytime they and their scumbag associates funnel or JUSTdefraud money from the tax payers, the country we have to do something to make up for all of the money they have been taking.

Good for them, why should we be held accountable for this loophole that many illegal immigrants use to help stay in this country.

It's in the Constitution, and I don't know about you, but I'd be a little uncomfortable with establishing an exception to the amendment process for the Constitution on the grounds of "it really really needs to change guys, for serious".
