Other than maybe trying to recalibrate the circle pad or clearing anything that might be causing an issue, if its the d-pad its probably a connection issue and you might need to get it repaired from nintendo if you arent a tinkering kind of person
@lord_magikarp: It seems obvious to me that its the d-pad. The circle pad works fine. I don't think that there is something that I have to clear that is causing the issue because it started to happen while I didn't have internet access. I hope I don't have to send it in.
@GameboyTroy:was there a glue on the "up" d-pad? if so...maybe use a needle to pull it out, just make sure the 3DS isn't active.I tried this myself
what was your 3DS like? the original design,XL,or New?

There is no glue on the up part of the d-pad. The d-pad is not sticky. It is the original design.
@GameboyTroy: the original looks a lot smaller to me,then try to do what I say, gently pull back the up d-pad using a needle,no harm trying though. it's weird that the up pad is sticky without glue exposure, then again I coped with the same problem elsewhere, did the same needle fiddling, and it's all good.
@crazypal: I think they do have all retail games in the eshop. Buy the games you want from there. Downloading the digital versions of the retail games will take up more space on the SD card than buying them from a retail store.
Try letting go of the up button on the D-pad >.>
jk, Sounds like you might have to send it in. I haven't heard of this problem having a common fix.
So nobody has been able to fix this problem without sending it in?

If you try to take care of the issue yourself, and Nintendo realizes that, i think that voids the warranty.
