ESA gets behind SOPA

Game industry representative body announces support of controversial online piracy bill, pursuing "right balance" to combat content theft.

Introduced in October, the Stop Online Piracy Act has proven to be a polarizing piece of legislation. And while some of the major players within the game industry have been silent as to their stance on the bill, the Entertainment Software Association believes its passage is in those companies' best interest.

In a statement today, the ESA announced its support for SOPA, saying that the game industry requires effective protection against the illegal acquisition of games and those who facilitate it.

As an industry of innovators and creators, we understand the importance of both technological innovation and content protection, and do not believe the two are mutually exclusive. Rogue websites--those singularly devoted to profiting from their blatant illegal piracy--restrict demand for legitimate video game products and services, thereby costing jobs. Our industry needs effective remedies to address this specific problem, and we support the House and Senate proposals to achieve this objective.

We are mindful of concerns raised about a negative impact on innovation. We look forward to working with the House and Senate, and all interested parties, to find the right balance and define useful remedies to combat willful wrongdoers that do not impede lawful product and business model innovation.

As it was first proposed, SOPA would allow the US government and copyright holders to request court orders against websites that are believed to be hosting infringing content. Those who do not comply with the order risk having payment services and advertising channels severed, as well as being removed from search engine results and blacklisted by Internet service providers.

Companies that support the bill--including the Motion Picture Association of America and National Football League--argue that it offers necessary protection to content creators. Opponents of the bill, such as Google, Facebook, Twitter, and the Electronic Frontier Foundation, argue that SOPA infringes upon First Amendment rights and will ultimately deprive the Internet of non-infringing content.

At the very most it will stop casual pirates. The vast majority of piracy won't be effected by this. This is the same as stringent DRM, in the end, it only hurts the legitimate consumer.

SOPA is like Nazi. If ur site/ channel has some content that conflicts with them, they will make you disappear. That's right, they will make it looks like your site/ your channel wasn't shut down, but rather never existed. Similarly, Nazi used to knock doors at night and make those who oppose them seem never existed. Only Nazis would support SOPA and therefore those who support SOPA are in a sense, Nazis.

There isn't a word nor emotion to fully convey my rage. SOPA cannot and will not do anything to deter pirating whatsoever, that responsibility falls on the companies that release the content, not the governments.

@komania you do realize that piratebay is not american ? wouldnt effect them in anyway..sopa will hurt the world at first (youtube,american sites etc) but then someone living outside the states will create a similar website, so in the long run its just americans who will suffer greatly..im not american but still thats pretty bs for you guys if it passes

You know what's funny? The Pirate Bay already designed a widget to allow you to directly connect via IP address to torrent anything you would like... So basically, SOPA isn't even going ti stop piracy >.>

@warhawk-geeby Get out more like stop following up your posts on gamespot? Lol. In seriousness though, this is a pretty dengerous piece of legislation. People are fired up for a reason. What's particularly irritating is that companies lining up behind this bill know that unchecked government bureaucratic power would introduce some serious problems for their industry, yet because they're the kind of companies that can handle these challenges being large or well connected, it actually behooves them to support it. It creates a nice legal barrier to entry for the market so they have less small upstart competition to worry about.

1. problem with SOPA is that companies can shut down there competition with a simple click then the gaming worlds going to have havoc 2. don't work with the house and senate there dumb 3. it's against the first amendment to simple censor out part of the internet 4. as announced some game companies dislike this bill means to them the bill has gone to far out of hand. 5. free to play gamer fans your out sorry your game will probable be shut down because it looks like or it feels like something that a major game company has made the game is banned

The problem with this bill is that it will allow them to go after the good with the bad. Post a vid with a bad review of a game, esp if it uses footage from the game, and you'll be a target. It puts way to much power in the content owners hands. It's also way to restrictive to the internet, which should be free to all people. The internet should perhaps have police, to go after criminals, but this is not the way to do it.

This is not going to kill facebook. What it means though is that the goverment would have the right to police the internet figures the stupid ESA would back this. the wording and title is misleading it makes you feel like if you "Dont" support it that means you want piracy. Yet the underlining factor is that the goverment and congress would have to the power to police the internet.. thats what it really means. given their track record do you REALLY want that?

I just can't get behind a bill where the Music, Movie and Video Game industry get videos posted by the users who buy their products taken down from youtube, only for the Music, Movie and Video Game Industry to use Youtube to show off music videos, movie trailers, video game trailers, Video Game walk throughs ect. If They didn't want piracy to happen maybe they should have actually fought against the creation of the CD/DVD burners.

@Rocker6 You'd be surprised, friend. The ESA is the trade association of the video game industry in the USA, sort of like the RIAA for music and MPAA for movies. They also run E3. Who they are? The members include (but are not limited to) the ff: Atari, Capcom, Disney Interactive, Eidos, EA, Konami, Microsoft (I think), Nintendo, Namco Bandai, Sega, Sony (both SCEA and SOE), Square Enix, Take-Two, THQ, Ubisoft, Warner Bros., etc.

@redskinStu (cont) Universal Music then sent a takedown notice to Youtube saying the video was copyrighted material, and Youtube took it down. Wanna know the funny part? Universal Music DID NOT OWN THE VIDEO AND THEY STILL HAD IT TAKEN DOWN. Now, Megaupload is (rightfully) suing UMG and hopefully Megaupload wins. Here's a corporation that actually has the power to take something THAT ISN'T EVEN THEIRS off the internet just because they complain that under the DMCA they have a right to simply b*tch about it and have it taken down. Under the SOPA, not only would UMG have had the right to take it down, but also have youtube declared as a rogue site and have it taken down as well. AND IT WASN'T EVEN COPYRIGHT INFRINGEMENT AT ALL. Under the SOPA, it would also mean that Universal Music would be IMMUNE to countersuit, and not only that, it would also mean that even if Megaupload were to successfully defend itself in court, Megaupload would still have to cover it's OWN LEGAL FEES. Here's a company that can harass a site wrongfully, be immunte to countersuit, and still have you pay legal fees even if you were the one being harassed. Big surprise UMG is one of the supporting companies of SOPA. Wake up. SOPA is Unconstitutional. It tramples upon the very rights that the US claims to so dearly love and protect.

Didn't even bother to read up on the recent activities of certain companies involved in the support of SOPA, did you? Need I remind you of the Megaupload vs. Universal Music suit currently in court? In case you didn't know, Universal Music complained that Megaupload was a rogue site and service of the file sharing site was taken down. In response, Megaupload got the support of various artists and they made a song to promote Megaupload---a song/video OWNED by Megaupload, which they put on Youtube... (cont.)

Hopefully your Supreme Court has more sense. I'm a Law student here in the UK and even I can see the constitutional s*** storm that is coming Congress' way. Even if you discount the first amendment issues, If you actually read the bill it provides for a maximum sentence of 5 years imprisonment for streaming more than 10 pieces of content in less than a 6 month period. Not only is that completely impractical but you'll be filling federal facilities with ordinary citizens and fining many more, hell even kids. What I think you'll find though is that this results in companies that provide search results, advertising and payment services as well as video sharing of any kind shutting down US operations. Hell I would. The system would become totally unworkable. But hey if the ESA is on board we can add E3 to our s*** list.

Censorship of any form, especially of something that's supposed to be free from any restrictions and is the main way for people to share information of any kind, should never exist. We already have the NDAA which lets the government take anybody being suspected as a terrorist and send them somewhere without proper trial. With SOPA and other net censorship schemes, there is a great potential especially for its misuse. For example, you can say your group is only peacefully demonstrating, but with SOPA, if they find anything in your material that may seem like it belongs to them, the corporations, they have every right to censor your site or any information about you on the net. The NDAA and SOPA combo only spells disaster for our rights, these things give the government too much power to control what they can do and what we can't do. The NDAA must be protested against as well as any form of internet censorship for the sake of our future, otherwise, we will spiral down into the darkness of cloaked tyranny in the guise of a democracy.

I hate this bill but understand why its needed. However it is too risky to support because of the massive potential for abuse by an already abusive government. Well I hate the pirates because their enterprises are the reason this bill is being created but also hate the government because I am 90% sure this will be used restrict our rights and freedoms along side the whole combating piracy thing. Hmm well looks like my opinion is null and void then.

Honestly - all of us, whether guilty of indulging in it or not know deep down inside that ripping off materials available for retail or licensed in your region of the world is a problem. Nonetheless, SOPA and it's evil little siblings such as Net Neutrality all lay down the groundwork to severely limit and monopolize the public's ability to access all web content within reasonable means. Net Neutrality for example will have you pay additional fees to just view additional sites. To access Google may be provided with your standard service via your ISP, but to visit Nike or other sites monthly could be an additional $10 a month. More specific to SOPA the US gov't is currently shutting down sites sharing unlicensed material. One site in particular was shut down when they would without a fight remove material that became liscenced in the States. They are doing this now without SOPA even in the books. In this time of financial disparity, my tax dollars can be put to better use. If this was purely a change to protect licensed material - then I would understand. However, all evidence points to as this being the first move to neuter our web access to further stuff the pockets of corporate fat cats. ESA - I'm with you on so many things, this for sure is not one of them..

@Gigaman222 I guess we just see things different then. To me, doing something out of desperation is when you steal food because your starving and have no money. Someone downloading Skyrim because they don't have the money or think its too much seems more like just being cheap and lazy to me. Maybe its just the people I've been around but I remember back in high school all the other anime fans wouldn't even spend $2 for an episode on itunes because they wanted it free and in Japanese. I remember telling them that if everyone kept pirating something bad was going to happen eventually.

What exactly does the ESA, or MPAA for that matter, produce? Oh right, nothing, they represent the bad portions of their industry, the exceedingly greed. What they never seem to realize is that they never earn more money this way, in fact, they often lose money with these ridiculous DRMs. I just hope there's enough support in Congress to oppose this bill.
