Bungie, Activision lock down 10-year exclusivity

Suburban Seattle shop will remain independent, develop wholly owned new IP exclusively for Call of Duty publisher through 2020 on "all platforms" Microsoft retains Halo ownership; Sony says PS3 edition will be "Halo on steroids."

With a potentially $625 million lawsuit filed against Activision by Infinity Ward employees this week, it didn't seem possible events surrounding the publisher could get any more dramatic. Then, this morning, Activision announced it had locked down one of gaming's top developers for a decade-long exclusivity deal.

Expect to see the Activision logo next to this through 2020.
Expect to see the Activision logo next to this through 2020.

Under the terms of the agreement, the studio behind the heralded Halo series has allied with the Call of Duty: Modern Warfare 2 publisher for "an exclusive 10-year partnership to bring Bungie's next big action game universe to market." The deal will give Activision exclusive international publishing rights to all future Bungie games based on an unnamed new property through 2020.

According to Activision COO Thomas Tippl, Bungie's "new intellectual property" will be available on "all platforms"--including the PlayStation 3. Sony Computer Entertainment America corporate communications chief Patrick Seybold backed it up with a Twitter post, saying, "Marrying [Bungie's] creative minds and incredible talent to the power of PS3 will be like giving PS3 fans Halo on steroids."

The multiplatform move marks an end to the suburban Seattle studio's current Xbox 360 exclusivity. Since 2001, Bungie has effectively developed Halo games solely for Xbox platforms, farming out the PC port of Halo: Combat Evolved to Gearbox Software (Borderlands) and Halo 2 for Windows Vista to an internal Microsoft Game Studios team.

Activision Blizzard COO Thomas Tippl and Bungie president Harold Ryan.

Microsoft Game Studios had been Bungie's exclusive publisher, as Microsoft owned the studio until 2007. That year, the shop stunned the industry by breaking away from the Redmond, Washington-based software giant to become an independent shop. Reps for the studio have previously said that it is working on an all-new game and that Halo: Reach will be its last Halo title.

Microsoft continues to own the Halo IP, and recently formed an entire internal division, 343 Industries, to manage and develop it. Following the deal, it gave the following statement after the Activision deal was announced: "Our partnership with Bungie as a first-party developer for Xbox 360 remains unchanged, and right now we're deeply engaged with them on the development of Halo: Reach, which is poised to be the biggest game of 2010."

Today's announcement underlined the fact that Bungie will remain an independent studio and retain ownership and control of its new IP, with Activision providing publishing duties and (presumably) financing. Those terms sound eerily reminiscent of the arrangement struck between Electronic Arts and Respawn Entertainment, the indie studio recently formed by fired Infinity Ward heads Jason West and Vince Zampella.

To hear Tippl discuss the deal--and literally say "let's kick EA's ass!"--check out the video press below. (Video starts at 1:04.) To hear Bungie explain how the deal go down, read GameSpot's interview with community manager Brian Jarrard and writer/design director Joseph Staten.

All this Activision/EA nonsense is starting to remind me of high school nonsense. Or a really bad soap opera.

Bit of a strange move I agree, though Halo is still owned by Mircosoft, it may mean Bungie can make other games and maybe get in contact with Take Two and take back the Myth IP and make Myth 4, though it would never happen its a nice dream.

Come on fellow gamers...Bungie brought us a new level of shooter with Halo and will most likely produce a product superior to Halo in the future. Activision may seem evil to some, but they have deep pockets and Bungie is the company developing the software so I don't care who publishes it. Halo is rather long in the tooth and it's time for a new franchise. It's about time all consloes get some Bungie love!

M$ still owns all of the Halo resources so their next 2-3 halo games could be really close to Halo 3. They have all of the code and artwork so all they have to do is find a small FPS rooted company looking for a big payout. They probably won't equal the story quality but any Halo fan is going to buy the game anyway. And @Alex_09, I agree with you 1000%. Bungie going multiplatform won't change my game buying one bit. Odds are their new IP is going to be "a sci-fi based FPS with deep multiplayer options". It'll probably be called Olah.

@supernaught360 where exactly have you been for the past few years? If exclusives matter than of course 360 would be above the others. PS3 has GoW3, MGS4 (which was mostly a movie), Killzone2, Little Big Planet, and Uncharted 2, and Heavy Rain (if you can honestly count that..) 360 had: Halo3, Mass Effect, Mass Effect 2, Gears of War, Gears of War 2, Fable 2 And will have: Alan Wake, Halo Reach, Gears of War 3, Splintercell: Conviction, Crackdown: 2, Fable 3, also a much better online than PS3, still. I've been waiting for PS3 to make something good.. MGS4 almost swayed me but after hearing the ratings.. No thanks.

What's the point of buying Bungie without the Halo brand? To make some Halo knock-off for the PS3? You don't need to pay a king's ransom to a one-trick development house for that.

Oh, c'mon - hasn't anyone learned yet? This console generation has seen the definitive downfall of exclusive games, and how they relate to console sales. It's OVER people, get over it. Modern gaming enthusiasts are more interested in features than exclusives, and XBOX LIVE is selling 360's far more than Gears Of War, Or Halo. If exclusives were still important, the PS3 would be WAY ahead of the 360 right now, with Little Big Planet, Uncharted, Killzone, Metal Gear, etc. And since when has Bungie innovated anything?? Halo is a dated FPS at best, and Bungie hasn't proven themselves otherwise. I mean, Alex Seropian was the guy that practically created Halo, and the best he's done since leaving Bungie is Stubbs The Zombie - and it's a piece of awful.

To quote Battlestar Galactica "all of this has happened before and will happen again." This is how it will go down, the development of the first game will go great activision will give them plenty of time and lots of money for development. Then they'll talk to bungie and say "hey that first game went so well why don't you guys sell the company to us? Everything will stay the same except you'll get lots of money." Bungie says "Ok." Then the every other year deadlines start and activision will station a lackey at the bungie studio and ask for game development updates everyday. Then after the release of the next installment all the higher ups get pink slips for insubordination. And the process starts all over again. So the wheel turns!!

Once the Halo series runs out of milk, that'll be one less system seller IP for Microsoft. They're going to have a harder time competing with Sony in the years to come unless they can come up with another hugely popular product.
