Assassin's Creed Unity Free Game Offer Waives Lawsuits

Fine print states that accepting free game means you can't be part of a lawsuit against Ubisoft over the game's rocky launch.

Ubisoft's free game offer that serves as an apology for Assassin's Creed Unity's launch troubles comes with one major stipulation. Those who claim a free game, according to the fine print, are agreeing to never sue Ubisoft over Unity's woes or the now-diminished value of the game's DLC pass.

Game Informer spotted the important legal terms, which you can read in full at the bottom of this post. To sum up briefly, it says that by accepting the free game, you're waiving the right to sue Ubisoft or any of its divisions, either through a solo lawsuit or as part of a class-action legal battle.

This kind of measure is not uncommon in gaming. In fact, Xbox Live, PlayStation Network, and Steam all have similar legal terms in place that block class-action suits.

Unity's launch in November was marred by a long list of technical troubles, most of which, however, have since been fixed through subsequent patches. Just before Thanksgiving, Ubisoft announced the free game offer, allowing anyone who bought the game's DLC pass to choose a free game from a list that includes some pretty great games.

If you didn't buy the DLC pass (and it's since been removed from sale), you're still getting free content in the form of the Dead Kings expansion. This was originally supposed to be included with Unity's DLC pass, which explains why it's also mentioned in the lawsuit waiver terms below. Ubisoft has not yet set a release date for the Dead kings expansion, but when it's released, everyone will get it free.

You hereby irrevocably and unconditionally RELEASE, WAIVE, AND FOREVER DISCHARGE AND COVENANT NOT TO SUE Ubisoft Entertainment S.A., and each of its past, present and future divisions, parent companies, subsidiaries, affiliates, predecessors, successors and assigns, together with all of their respective past, present and future employees, officers, shareholders, directors and agents, and those who give recommendations, directions, or instructions or engage in risk evaluation or loss control activities regarding the Campaign (all for the purposes herein referred to as “Released Parties”) FROM ANY AND ALL LIABILITY TO YOU, your assigns, heirs, and next of kin FOR ANY AND ALL CLAIMS, DEMANDS, CHARGES, LAWSUITS, DEBTS, DEFENSES, ACTIONS OR CAUSES OF ACTION, OBLIGATIONS, DAMAGES, LOSS OF SERVICE, COMPENSATION, PAIN AND SUFFERING, ATTORNEYS’ FEES, AND COST AND EXPENSES OF SUIT, KNOWN OR UNKNOWN, SUSPECTED OR UNSUSPECTED, ARISING OUT OF OR RELATED TO THE PURCHASE, ACQUISITION, RENTAL, POSSESSION AND/OR USAGE, AND/OR THE INTENT TO PURCHASE, ACQUIRE, RENT, POSSESS AND/OR USE, THE ASSASSIN’S CREED UNITY VIDEO GAME AND/OR THE ASSASSIN’S CREED UNITY SEASON PASS ON ANY AND ALL PLATFORMS, AND/OR RELATED TO THE CAMPAIGN, WHETHER CAUSED BY THE NEGLIGENCE OF THE RELEASED PARTIES OR OTHERWISE.

I'd best describe this situation via a restaurant analogy:

[in one of those perky "fake smile" voices]

"Look, sir/ma'am, we know you paid for a hot plate of steak, and we had rat crap in it. But while it's getting cold and we're literally still cleaning the crap out of it, we know you're already hungry. And so to say 'we're sorry,' here's a plate of free salad to tide you over. BUT remember, once you bite into that free meal, ya freeloader, you can never again complain or blame us about the paid crap that we gave ya in the first place, EVER! Understand? Wonderful. Now let's just get that in writing, shall we? Thanks, and come again!"

Seriously, @Ubisoft? You're basically makin' your most loyal supporters choose between getting an apology OR getting Justice from you?? That's one helluva dick-move right there, if there ever was one. And if Microsoft, Sony and Valve are all doin' the very same thing as @Mr.Makuch said in the article, then they're all just as guilty. Shame on them all. As they say, Karma's a bitch, and y'all gonna learn that lesson sooner or later.

And folks wonder why even Pirates and/or Hackers are considered more principled than you. Heck, at least THEY always side with their supporters.

This is so shady I'm not sure I could back Ubisoft anymore. I was defending them in spite of the bugs but to do this to their customers is extremely unethical. They deserve to get any backlash they get. I'm also probably not going to buy any of their games anymore for a while until they get their act together.

To be perfectly honest, if you don't have anything better to do that construct a lawsuit towards a game developer due to a poor game you played, you actually DO need to get a life.

So can someone explain to me why The Division has 5% of the vote for most anticipated game in 2015? Who would give Ubisoft the benefit of the doubt given their recent track record? That percentage point puts it right along side these games.

  • Batman: Arkham Knight 4%
  • Bloodborne 5%
  • Metal Gear Solid V: The Phantom Pain 6%
  • No Man's Sky 6%
  • The Legend of Zelda Wii U 4%
  • Uncharted 4: A Thief's End 6%

Ubisoft is and was a single player franchise and they fired the only really creative mind they had in 2013. Social gaming is a bore and they should have stuck to dingle player for XBOX one. It takes stupid people awhile to get bored with a thing like social gaming, but they will because by nature it must be limited. If a boring stupid game like Destiny can be up for game of the year, the writing is already on the wall. Ubisoft - you need to fire whoever is in creative control now and get some proven game creators in or see your company die.

<< LINK REMOVED >> Do you really think liking "social" games (such as Smash Bros, Civilization, Counter Strike (CS1.6 for life, baby!), XCOM, ect) are the qualities of a stupid person? This could be a huge breakthrough! Goodbye IQ tests, lets just see whether greenshadow approves of your media choices! Job & school interviews would certainly be simpler as well. Be sure to let me know when the next great "dingle player" game shows up so I can show everyone how smart I am. Although now that I've thought about for more than, I don't know, .0001 seconds, liking different games than you is not really (or at all) related to a person's intelligence.

Tip: feeling superior based on what sort of books, movies, or games you like gives people the impression that you are so untalented and generally lacking in good qualities that you have to brag about the things you buy- things that other people with actual intelligence and talent made. Not that this applies to you, but someone might see you calling people stupid for liking something you don't and naturally come to the conclusion that you are immature, insecure, and ignorant. In general, putting people down for having different tastes than you isn't really associated with intelligence as much as say, douchey-ness.

ok so now we know their true motive for giving away a free game...it wasn't as an apology.it was as a guarantee they won't get sued.they didnt give it away because they care about their customers.once again all they cared about was their back.this is shameful, low, pathetic and a coward aproach ubisoft.

<< LINK REMOVED >> thats not true because i have emails to prove along with dates how about you can you tell me when did this lawsuit start and we will see whats fact. i got my email about free game before lawsuit even started or was a thing in media and fact is the fine print wasn't even in effect till my second or third email.

It makes sense anyways if your gonna sue them why should they apologize to u or make up anything to you for that matter. You would do same in their shoes since they already paying just to patch and fix all the issues with the game therefore leaving no reason to sue Ubisoft but for a brief inconvenience which means the lawsuit is more then ikely going nowhere due to that fact alone. So think about it they are still giving you the product you should have gotten at launch and yet still choosing to make up for the inconvenience as well only for someone to take all of it and still sue them only an idiot would allow themselves to be taken advantage of that badly and their not stupid.

why do you still post news about ubisoft?they failed so hard this year and showed their true faces.everyone should just stop buying their shit products.first of all releasing a game in a state in which ac unity was is unacceptable.then the apology?was that supposed to fix anything?really?they clearly knew the game was unfinished.there is no way in hell they didn't know that.all they had to do was play 5 minutes of it after they "finished" it to see how broken it was.so they knew it was broken and they STILL released it.so does their apology really mater? "sorry you gave us 60 dollars or euros for a game we deliberately released unplayable thanks to corporate but we hope you don't care because you are already used to us treating you like shit with recent releases".This shit has to stop.STOP BUYING UBISOFT GAMES

Seeing how this game had a lot of fix patches the size of a full downloadable game,I highly doubt I will be able to Buy it.

by the looks of thing a new AC game set in England will be out next year. Well if people still buy them despite of the bad publicity they had with Unity then I can't blame Ubi for doing so.

AC II is still the best AC game imo, after the first game which wasn't as people thought would be, AC II came out and fixed the problems that the first one had.

Dont rush your games Ubi & try making a Prince of Persia game while your at it.

I'm happy to play Far Cry 4 for free (I haven't experienced anything that majorly affected my gameplay, have a decent co-op experience with only one mission that appeared bugged because I kept disconnecting everytime we failed to complete it) untill they fix Unity.

After the first few games I cant take this series serious anymore, its a massive cash cow now and the writers will write anything down for its story to keep proceeding, they have always been the same old generic repetitive game that gets boring after a few hours play, at least that's what I think of these games, dont know about you.

That's obvious that they should have delayed game but didn't, maybe they thought they could DELIVER UNITY in a same timely fashion they have been delivering last gen AC titles but obviously didn't pan out that way and i am sure it has alot to do with DEvs dealing with a new toolkit and console but still i would agree that is no excuse and that they should have had better quality control like i said before. At same time this was a major first for them and i fell they handled the whole situation better then most publishers would have by apologizing and making it up to their consumers with free DLC or game and while still patching up the game breaking bugs. What more is expected they admitted to being wrong and apologized while not only rushing the patches but also making up for the inconvenience with free DLC and a game which btw some of the games on the list alone were worth 60 bucks never mind free DLC. Hey not saying whole situation was right but we still made out with alot for what happened and game is still good and fixed up in the end. I'm sure they got the hint that their customers don't want nor will expect this kind of practice again and how they handled whole situation to me proves that.

How many games are out that have bugs or issues that never get fixed yet no one cares because its from a small time publisher nobody hates or expects much from, yet since Ubisoft is successful and because Unity is a AAA title from a successful publisher that people like to hate on for simply being good at their jobs and making money they are getting even more flak even after all is said and done and they do right by their customers after the fact.
