3D Realms closure confirmed, Take-Two retains Duke Nukem Forever publishing rights

[UPDATE 2] Online accounts finger monetary issues in demise of developer, which still owns IP; publisher says arrangement "did not include ongoing funds for development of the title"; DS, PSP spin-offs "unaffected."

In the 12 years since Duke Nukem Forever was announced in 1997, the game's ever-shifting "when it's done" release date became a running joke in the game industry. Today, though, comes news that few will find funny. According to numerous reports, the elusive shooter's developer, 3D Realms, has informed its staff that it is ceasing operations.

Though it did not explicitly confirm the closure, the recently relaunched Apogee Software and its publishing partner Deep Silver issued a statement saying that they were "not affected by the situation at 3D Realms. Development on the [portable] Duke Nukem Trilogy [series] is continuing as planned." The Apogee label was relaunched by 3D Realms during last year's Electronic Entertainment Expo and was billed as a portable-dedicated branch of the company.

[UPDATE2] Unfortunately, it seems that the rank and file of 3D Realms proper were not so lucky. In response to a flurry of shutdown reports on the studio's official forums, longtime webmaster Joe Siegler issued a glum confirmation. "It's not a marketing thing," he said, addressing theories that the news could be some sort of guerrilla PR campaign. "It's true. I have nothing further to say at this time."

Adding to the clouds above 3D Realms was a report on Shacknews, which has deep ties to the PC shooter community. Citing "a reliable source," the site reports that employees of the studio were told of the closure this afternoon. The report said that monetary issues were the culprit, which has led many to believe that longtime publishing partner Take-Two had cut off funding for Duke Nuke Forever.

[UPDATE] Citing company policy, Take-Two vice president of communications and public affairs Alan Lewis declined to comment on reports of 3D Realms' closure directly. However, he did say that the company "can confirm that our relationship with 3D Realms for Duke Nukem Forever was a publishing arrangement, which did not include ongoing funds for development of the title. In addition, Take-Two continues to retain the publishing rights to Duke Nukem Forever." Lewis also confirmed that the DNF IP is still owned by 3D Realms.

3D Realms' closure marks a cruelly ironic end to the Duke Nukem Forever saga. After being completely restarted from scratch using the Doom 3 engine, the shooter resurfaced in December 2007 in the form of a brief teaser trailer (above). After a quickly retracted Dallas Business Journal report said that the game was coming to the PC, Xbox 360, and PlayStation 3, several snippets were shown on the Web show of former Warner Bros. Interactive Entertainment vice president (and now movie producer) Jason "Jace" Hall.

This year, work appeared to be progressing on Duke Nukem Forever. According to 3D Realms studio head George Broussard's Twitter feed, Take-Two was shown the project on January 26 or 27. He made no subsequent updates about the publisher's reaction to the game, the fate of which is now uncertain. As of press time, requests for comment sent to Broussard had not been answered.

I would be very surprised in no one bothered to pick up the rights to Duke Nukem Sooner or later a Duke Nukem game will hopefully get to see the light of day and with any luck it will be developed by a team that can do it justice

I'm only 28 damn it! ;) I remember when I didn't have an HDD, and floppies still flopped lol. @javierkatana: If you want to kill Uwe Boll, put him in front of a mirror. A pitty for the lost jobs, but gamer wise, is the best that could happen. They hold the ip, activison will publish it, just pray for valve, infinity ward or crytech to develop it and there it goes, a 3 million seller done in the 2 years not 12. Also, get someone to kill uwe bowl so he wont ask the german gov to give him another 25million mandatory fund for movie arts, so he can buy the movie rights.

I weep with the memories of the future past. I remember back in the day when an average hard drive was 4 gigs and windows 95 and 98 was like sunshine on a rainy day. Alas we had but 2 meg video cards and surfed the internet POT style. The Duke ruled beck then.

3D Realms retains the IP but Take-Two has the publishing rights... Sell the IP to a company that won't take another 12 years- Epic, Valve, id, or Monolith. I don't want Bungie to get Duke Nukem. He's not their style.

They sort of deserved it. I love duke nukem but as a fan i felt sort of neglected. I patiently waited, but they would never show actual media of the game. After all the years we waited we got one trailer for a game that was scrapped along the way, a crappy trailer that only showed duke lifting weights, and a few pictures. The guys deserved it becuase they did NOTHING!. They had in there job description "we don't have official release dates" as a pro...... HOW IS THAT A GOOD THING WHEN IT MEANS NOTHING WILL EVER BE RELEASED!.

What a shame, I've been waiting a long time for this game. I love the first Duke game. I had a funny feeling that 3d realms was smoke and mirrors. It shouldn't take 12 years to make a game, hopefully Valve pick it up. I'm sure they would do a great job Or maybe Id Software.

If any one needs to pick this up, its not ubisoft, and not bungie, not Epic, it needs to be Valve. Dear Valve: We know you aren't doing anything with HL EP3, mainly cause you don't know how to end the series, we are ok with that, so put those people into Duke Nukem Forever! But really, this is a sad day... a very sad day. We'll get you Take Two for pulling the plug, we'll get you!

yeah man, go back to your birthday little present ..wich is? nintendo wii? behind all that production there is workers trying to do something hard and sometimes without money. a blast from the past to the future is what i want to see. bionic commando, metroid, doom or whatever the title is. like everything that is classic, we players sincerely hope that everything goes right for the 3d realms folks now unemployed or without a specific support, and the success of the duke nukem next title, no matter how the global crisis grows. many noob dont know that this character is older than the snes itself, in the golden age of the arcade's games and i dont want to see another title dead because of it. You guys need to stop saying that this game will never be released, what kind of players are you all? We got a story with those progammers dudes... be a little positive for a change ... even if this have to last a decade

This kinda suck...I mean Beeing a huge duke nukem fan as a kid...and now studying in the video game industry I know how it's hard for a studio to make good games and stuff that will sell...however some sucky studios are still living out there...wonder why it had to be 3D realm that closes....Even if we don't know about DNF's fate I guess a small part of me will always hope to see what I was dying to play as a kid...(maybe it's a good new if take two retains dnf publishing right) lol I guess people waiting for duke nukem forever, evil dead 4 and the next batman are all in the same pot...... :(

duke nukem hasnt been cool for 12 years, and even then he was just a constructed hash of other popular characters at the time thrown into a standard fps game, at a time when fps was new and almost everything you did was innovative. now duke is still pushing the arnold terminator 2 look, while terminator 4 is coming out. i dont know how anyone would even think that duke had what it took to be a lasting icon in games. when duke was cool you either played doom or duke nukem, and in most cases you played both, because they were the only fps. theyve been working 12 years on dnf, and theres no end in sight, almost half of gamers today werent even alive long enough to recall anything about duke nukem games, why bother tagging a crappy characters name that no one remembers, to try and sell a few more copies. duke nukem being in a game is a reason NOT buy in my book, the developers are wasting their lives. by the time this game is released, its going to sell a few copies to the people who played duke decades ago and still game, but i think the kids of tomorrow are going to see duke for the cheesy 90s pop culture icon amalgamation, created solely to take money from teenagers crying for an fps besides doom. as good as this game may turn out, involving duke nukem will only cheapen it in my opinion.

@ZedFragg: Hmmm... good point about T2 not having any real stake in this to take to court. I didn't think of that. As for the rest, well, that's why I'm not a judge lol, however I can see where you're correct on those points. I think you're right; that we'll never know what this game might have been... I mean, we barely have screenshots... It does make me a little sad. I suppose I just resigned myself to this scenario, or something like it, a long time ago. By the way, my personal favourite scene.. after Duke kicked the head of that boss through the uprights... Well, I can't really describe it here too well without getting modded. Lets just say I liked the whistling and paper-reading a LOT. I can still hear him whistling the theme song whilst... um... relieving himself in the neck of his foe. ;)

Maybe it's for the best. After waiting ages for development of Team Fortress 2, and being quite excited about pre-cartoon versions, the end result is extremely disappointing. The story of DNF development shows a similar lack of focus, direction, or integrity. I'm sure if it did see the light of day it would have been a very grim production. I will always cherish the old days when I could kick ass and chew bubblegum... even when I was all out of gum.

They should have just published the thing. How many times did they switch engines for crying out load. Entire game franchises have been created in the time this game was in development. What were they trying to accomplish keeping this game in development for that long? I guess DNF stands for Did Not Finish, not Duke Nukem Forever.
