Maybe, but I doubt the publishers care that much. After all, if someone releases your game a bit early, you're still getting the sale. They may care more for the sake of giving retailers an equal chance to make the first sale. With huge launches like GTA4 and Halo 3, I'm sure retailers are much more strict with honoring the release date.
Thanks StanleyL, I had no idea retailers have released before the street date (at least THAT much). It seems as though Fry's was not the only one who released it early, as I've heard around gamespot. Could they be liable for a lawsuit for breaking contract?
@Phatmista Because some retailers break the street date. Official Demigod site lists launch as 4/14. Or maybe you broke into the warehouse and stole it.
