@dalua360 @talkcasual There's only so many celebrities out there so it isn't that difficult to create unique looking character models. Sorry, but fact remains that SOMEBODY in the development team must've caught the similarities. I just think ND ran with it and then altered the image after to show effort to change the likeness in the possible event they got slammed with a lawsuit. They covered their ass*s. Ellen Page probably won't file suit and if she does, it'll be after the release of BEYOND or possibly before it to create hype. However, it would be venomous considering the already cult-like movement of TLOU.

@talkcasual @Law84 I didn't buy it for Ellen Page, in fact, her speaking out against ND is positioning her quite awkwardly for the BEYOND release. However, the fact of the matter is that regardless of ND's intentions in character modeling, Ellie resembled Ellen Page. Intention isn't a prong.

@talkcasual IF she takes them to court, she would most likely win. All she would have to do to prove it is point in the direction of the blogs/chats/this post - they are proof that people thought of it of their own volition. However, ND might win also since they took the steps to make the character dissimilar to Ellen Page. The ISSUE is that people must be able to associate the likeness with the person and in this case, the public identified Ellie's likeness as that of Ellen.

@dalua360 Copying the likeness of a "public figure" for profit without the rights to do so from the person is unlawful. CA has a publicity rights law, Civil Code section 3344, that says that individuals (usually celebrities) own the exclusive rights to exploit their images for profit - dead celebrities' heirs are covered, too. So if you're seeing t-shirts with celebrities' images, they're either licensed from the celebrity, or they're violating the celebrities' rights. Altering the images won't change the liability if the images are recognizable, and if they're not recognizable, no one would want them anyway, so anyone who thinks that changing a detail (or even a few details) from an image will protect them from being sued is likely be operating under a very expensive erroneous assumption. The law exists so she wouldn't be proving jacksh*t.

Yet Gamespot reviewed it at an 8.0. I'm still waiting for the review to be amended since worse games have made a 9. Side note: when are they going to release a 10 for a game? #drawnout
