Just travelled about 150miles to get a xbox 360 (while also there on business) and I bought one at an EB store. Got it home and noticed a problem right away. The seal was re-taped. When I opened the box none of the bags were on the components and i saw finger prints on the chrome part of the hard drive. I thought maybe they opened it to put the free game in so I fired up the system and voila, some guy named Alexander's account loads up onto Live. EB COMMITTED BLATENT FRAUD AGAINST ME! How on earth can they sell me this used ***** system with a straight face after paying so much money for it?
I'll be contacting the head office, the local store and possibly the local newspaper and go public with this. I thought about calling the police about fraud but that might be a bit extreme. Has anything like this happened to any of you? I just cannot believe my luck. This is just unspeakable and I've lost faith and trust in customer service completely.

I called the local store today and they claim the manager is not going to be there all day. This is the same employee that sold me the used xbox and she seems to be trying to completely blow this off as a minor error even after I told her how far I live away. I told her to call the manager and call me right back. So far no call back. She didn't offer me anything about a discount but I didn't bring it up yet.UPDATE 2:

I just was in contact with the local store manager and he started giving me an excuse that the system was knowingly repackaged and sold as new because the previous owner was a kid who bought it with his 1st pay cheque and once his parents saw how much money he spent, made him return it. Ok so this is probably true but he's tryign to justify me paying full price for something that has been opened and used. The manager doesn't realize you're not supposed to sell something used for a new price, especially if you HIDE this from the customer. Anyway he said he has no authorization to issue discounts nor did he offer me one but I have to take this up with EB customer service and report the store. I'll let you know what happened.
PS: The manager said he would not even recommend I buy a 360 because there are too many hardware problems. SO I guess its also true about these guys dissing the systems. Doesn't make much sense when you're trying to move product.
I'm back guys and I just want to thank you all for your support and I really hope this helps expose EB and their fraudulant activities. Here is an update on the situation.I contacted EB cust service center and they filed complaint with the wrong district manager (the DM from Alberta actually) so he called me back first and agreed that what happened was very wrong and shouldn't have happened and said he would tell my local DM to contact me and assured me he would work out a resolution.
Well of course the local DM called when I was at work but left a message stating that they sell used systems and package them like new very often and that they haven't done anything wrong to me and refuse to help in the matter. Basically, they want me to shut up and keep a used system I paid full price for. I will be in contact with this DM personally tommorow and if I don't get results, I will go to the media relations of EB and tell them I will be doing a story about this in the newspaper and contacting the BBB as well as contact the police on grounds of fraud. I know these images aren't very clear to see the packaging but I could not upload the full res image from my camera.

Hello everyone, I've been reading most of your comments and I want to thank you for the support again but I'm not going to even waste my time with those of you claiming that I am all BS and making this up. If that's what you believe, then please leave the thread and go do something else.I contacted EB customer service again today and they have escalated the issue to the next level above the district manager and assured me that they will work with me until the issue is resolved to my satisfaction. Tommorow I will drive the 60km to the nearest EB to exchange the used system for a sealed 100% new one since they've already got my money and I have no system to play until I exchange. They said this is fine and will contact me on Mon or Tues to discuss compensation for my troubles.
I see some of you defend EB but it seems you don't fully understand the reality of how EB works. They made excuses when I questioned them about this and never once apologized or offered any help other than telling me to drive myself to the nearest store to exchange. They take your money and that's all they care about. But to be fair, obviously there are some people in the company that do want to help me, but at the lower store level, they just don't care that they rip people off.
I also want to let you know that part of the reason I'm goign through this dispute process is to help prevent this fraud from happening again or at least reduce it for other customers because I know this is just wrong. Even though they are willing to exchange the system, they will keep on selling used items for new unless people start escalating the issues to management high enough to make changes. I cannot stress enough how wrong this feels, it is not a trivial matter and I will NOT treat it as such. I'll update again as soon as I am contacted. In the mean time, I hope I can start enjoying some gaming with the 360 tommorow once I get this thing exchanged.
FINAL UPDATE:
I went to the nearest EB store today to exchange the used system for a new one and made them open it and test it out in the store. The district manager also spoke with me over the phone to discuss compensation right in front of many customers I might add. He offered 50% off the Oblivion game I had also bought with the system but I told him I think it should be free because that would be more acceptable but he would not go for it. He did however admit that it was his fault for this issue occuring and will discuss this with the other DM's to change EB's policy on reselling used systems as new. He also apologized for the incident and I was glad that someone finally did. He is also going to have a talk with the store manager who was dissing the 360. So I really do hope that this event has an impact on the company's policy (at least in Canada) so this does not happen as much in the future. Like I said, I'm still not 100% satisfied but I'm glad to finally get a system I can use for now.Thanks for reading and be sure the next time you do business with EB to insist that whatever product you are buying is new and FACTORY SEALED. If not, simply refuse to buy such products and report the store to EB customer service which can be found on the contact us section of www.ebgames.com

That stinks. I'd be calling the store manager ASAP when they open tomorrow, if you haven't already. Make sure you know what will be acceptable to you before you call. Do you want a partial refund? Do you want a new 360? Are you willing to go back to swap? Will they ship you one in a box with return postage paid to send back the one you got? Once you know what your options are, you can press the store manager for results. If he does not resolve the issue, then ask for the DM's name and number. Someone probably bought the system played it and decided that they didn't want it and then returned the system without telling them that it had been used, although the clerk should have checked the packaging. When you do call, I'd be polite and keep a cool head but let them know that you are in no way satisfied with what happened. You won't get to far if with them if you start screaming at them. If you are telling the truth (I've been lied to before, not saying you did) then I would contact the local news and tell them your story. If worse come to worse sue them, but that your last option!

Talk to the manager of the store first and try to resolve the issue, I'm sure they will do what it takes to resolve the issue. Only if they won't do jack for you is when you turn to other options. Even then I'd just go over the store managers head to the DM. You should let the store try to make good on their mistake before you get crazy with the situation.- Please wait.
