German court rules Xbox 360 and Windows 7 devices banned in country following Motorola patent suit, but US judge orders phone company not to have ruling enacted just yet.
A German court has granted Motorola Mobility an injunction against the distribution of Microsoft's Xbox platform line in Germany, Reuters reports. The Mannheim court ruled today that Microsoft must remove a string of products from the German market, including the Xbox 360 and devices running the Windows 7 operating system.
The move will not have immediate implications, the site reports, because a US district court in Seattle, Washington, has granted Microsoft a preliminary injunction against Motorola that prevents the phone company from enacting the German order.
"Motorola is prohibited from acting on today's decision, and our business in Germany will continue as usual while we appeal this decision and pursue the fundamental issue of Motorola's broken promise," a Microsoft representative told the site.
Additionally, Reuters reports that Microsoft has already moved its software distribution center in Europe from Germany to the Netherlands, ahead of anticipated decisions in the ongoing patent trials.
This news follows a US International Trade Commission judge determining last week that Microsoft's Xbox 360 hardware infringes on Motorola Mobility patents for video decoding, Wi-Fi connection, and console-to-accessory connections.

Well first things first this could skyrocket sales of the PS3 in Germany and from what I can see Motorola are betraying Microsoft,another point no one really cares for Windows 7 cause Vista is fine if you have a decent Anti-Virus but overall it won't make an insane difference if it only gets banned in Germany but if it goes through in America I'd say Microsoft would f**k up unless they release the next gen Xbox early

Personally I look at a president as a human being that can make choices and has limits. Everyone president has.. and everyone always will. *Like for instance some stores will not allow Explicit Lyric cds to be sold, but they sell mature rated films. Why can't this be evened out and just let them sell what they can. IT might boost music sales a bit. Just as an example.

What it actually said is that Motorola filed an injunction ("An injunction is... a court order that requires a party to do or refrain from doing specific acts" -wikipedia) against Microsoft, preventing them from selling certain products in Germany, including the 360. "The Mannheim court ruled today that Microsoft must remove a string of products from the German market, including the Xbox 360 and devices running the Windows 7 operating system." (Sentence #2, for the record).Of course, you'd know this if you'd read the article.
1 Like i live in germany and about the censorship of violence its true, games get censored and banned all the time if they are too violent or bloody (they cut the whole airport mission in cod and thats a small example!) and this comes as no surprise... and microsoft will have heavy losses if they lose the german market, the games and electronics are pretty expensive here (i often order games from the UK because theyre uncensored and cheaper!) but i prefer my PS3 anyway and windows mobile is pretty bad compared to other mobile OSes... no loss for me but a hard hit for microsoft!

The american court not subdued the german court. Apparently, U.S. judges banned that Motorola continued to implement the decision issued by a german court, under penalty of a fine imposed on Motorola in the U.S territory.
Not sure why I did not read the case, but it must be something like that. But one thing is fact, the boss in Germany are Germans.

Microsoft is a United States based company so they are allowed to be represented by a Unites States Attorney. Microsoft has the right to an appeal and these trials can go on for a looong time.
