Nasdaq wags finger at Activision

Spider-Man 3 publisher fails to report quarterly earnings in time in wake of stock backdating scandal, could face delisting.

Activision today said that it has received another warning from Nasdaq after failing to file its earnings for the quarter ended December 31, 2006, in time. The publisher also said that the warning was expected.

This is the second straight quarter in which Activision has failed to file its earnings in time. Both delays were caused by internal investigations into stock-option grant practices. However, the company did issue a recent "preliminary" earnings report in which it claimed it sold $822.8 million worth of games during the fourth quarter of 2006.

Activision was granted continued listing on the basis that it files both delayed quarterly reports by May 9 of this year, but the company says that there is no assurance that it will be able to. If it fails to file its reports by that date, the company's stock could be delisted.

"i hope the company goes under like Interplay"

Totally! As a gamer, there's nothing I would love to see more than all the publishers go out of business! Then I wouldn't have to choose between which games I should spend my money on.

Activision needs to shut down treyarch as they are currently an undiscovered blight on the industry. All they have bean doing is just making games that a lot of people buy with absolutely no information other than the liscense to go off of. Examples are, call of duty big red one (what were they thinking), Call of Duty 3 (GET OUT OF WWII OR GIVE INFINITY WARD ITS GAME BACK), Spiderman games (come on, were any of them NOT average and hastily put together.).

they deserve worse. after screwing over the original Call of Duty developer, stealing their IP, and pretty much destroying their company...then going on to make millions on crap sequals, and they still can't do things right with all that stolen money. i hope the company goes under like Interplay, though i suppose the CEO and the other top ****heads will get away with the money and no penalties while the employees suffer.

I like Call of Duty online. I don't think they will go out like Acclaim did.

If you would take the time to learn about reporting Jerian you wouldnt' make such comments. I have been a full charge bookkeeper for 13 years and I will tell you there are many internal situations which could delay reporting which are clearly out of the bookkeeper/accountants hands. This being said, when a company is listed on the NASDAQ chances are they are trying to make sure they are as accurate as possible. If anyone wants to continue with the accusations Activision is still trying to cook the books then I ask any of you why would they need to?

With hits such as call of duty alone why would anyone even venture such an outrageous claim?

And Rain...what are you smoking cause if you missed the whole COD franchise then perhaps your also living under a rock.

    Peace

The Nasdaq gave Activision the finger? Anyways, I guess the assumption is they have something to hide. I hate to see yet another company go though, less devs means less chance for variety.

This really isn't that big of a deal.

A company I worked for once missed the deadline for reporting something or other and NASDAQ delisted us. The next quarter, we were relisted. It didn't affect us in the least.

Rain05, your so smart... oh and EccoCid, how do you take risks without any capital? So all these independent studios will be able to publish this risk of creativity with what money?

  • rain05

Who cares activision is one the worst gaming studios out there besides eidos. They came out with lame movie based games every single year. There only real Star is the Tony Hawk Franchise which has been declining since part4.

I still remember the day I got Kaboom! (Activision's first game) for the Atari 2600. If I'm not mistaken, I think Activision was the first third-party developer ever for a game system.

If activision did fall you just know EA are going to buy it like a bargain basket game at the store, i.e they wanted to buy it to see how it is and it was really cheap at the time but chances are they won't enjoy it and Activision will sit on the shelf for ever and a day

    "gilbrod:
Seriously.... what difference does it make if they are delisted. it won't stop them from making games."

And seriously you know nothing about economics.

When a company is listed in the stock markets, that company has easier meaning of exchanging stocks: buying, selling, which would give them better access to a better (or worst) share value in a shorter time. With higher value, you get more funds. But to have higher value, you need to have good earnings or profits. Then it gets too long to explain. Do you see yourself selling shares on the street? Anyone remember when Google started to list it's stocks during the first couple of minutes? Those Google's founders became multi-millionaires in a matter of seconds.

    Get some knowledge people.

BIGBoss - Every major developer makes great games and crap games (well, capt maybe Nintendo). While EA is certainly not an inspired, creative developer, I can't stand by the besmirching of UbiSoft, which has published some of the greatest console games ever (Prince of Persia, Splinter Cell, Rayman) or Activision, financier of Id, the legendary PC games developer. These companies are light years ahead of EA

activision is just another ea/ubisoft which means they want money first and to make good games second i know its a business but tell that to kojima games they would never compromise the quality of there game for money at least thats the feeling i get from them

Activision can still sell games? $822 million to mee translates to a lot of low standards.

I would think getting delisted would hurt them, and that that would be a big enough incentive to get on the ball with filing their stuff.
