@Australians Bethesda are the client of the lawyers in question. Lawyers obey to THEM, not the other way around. Another who makes no sense at all. The joy of stupidity....
@OverRatedStuff Oh yeah sure, what you say makes so much sense. There's like hundreds if not thousands of IP containing the words Dungeon and Dragon. A few popular examples: Dungeon Siege Dungeon Keeper Dungeons Dragon Age: Origin Dragon Ball Z And while, yeah, Zenimax are the ones suing over Minecraft makers, it's still pretty much Bethesda too. Both companies are very close. They're pretty much the same company. It's not like EA, Acitivion, THQ or whatever. Zenimax is like the publishing division of Bethesda, but it's still Bethesda. So yeah, you make no sense at all.
@stakex007 well thats the problem isnt, it...nobody is asking for this bickering...neither of them wanted to do this...according to the public statements made by both sides(if its true or not...its a diff question)... if neither wants to do it, why are they sueing eachother!? seems like both of the legal departments are itching to do somthing, mohjang at least offered to give up the rights... there are no damages yet... IF ...IF! mohjang tried to rip off the elder scrolls franchise blatantly...then you could step in and sue for quantifiable damages... its likely going to be a game that has nothing to do with the elder scrolls theme/setting/chars etc. this lawsuit is just wishes and fears. Just a bunch of butt-covering in an attempt to cock-block, the possible cock-block that may or may not happen. the precedent for launching lawsuits has become more about corporate tactics, preemptive strike... instead of being there to protect people.... its being used to manifest the interests of the party with the better lawyer. mohjang having given up the rights willingly!, only to have bathesda still take them to court anyway, seems a bit abusive. I sincerely hope they get slapped with some punitive damages when this is over wasting peoples time and money.
It's actually ZeniMax Media, Bethesda's parent company, that is suing Mojang not Bethesda itself. Even though I don't condone what they are doing, I completely understand why they wouldn't want anyone using Elder or Scrolls as names for their games. Look at what happened with Dungeons and Dragons, it's pretty hard to count the number of games containing one of those words on both hands and feet.
Who the f**k thought they should pick the one person in the world who can't make (and should be legally forbidden from making) a sandwich then film it? Although the stupidifying design of the sandwich is a direct representation of that legal fight...

In the example "The Elder Craft" first to sue you would be blizzard with the biggest craft games and then Bethesda with the elder, to me it sounds kind of weird to own words.
I'm gonna make a game called "The", say "The" is the name of some nefarious villain in the game and is actually pronounced some other way and then trademark it. Seriously though, this case is just leveling down Bethesda's reputation with the Gamer faction, heh.
I love mojang but I'm behind Bethesda on this. While i highly doubt Mojang intended or even really paid any thought to how close the titles are, Bethesda should be able to strike them down in such a small dispute if only to cover their very long running franchise well into the future. The fact that Mojang wants "scrolls" covered across all mediums possible makes them kind of seem like the asshats. Bethesda is at least reasonable about their coverage.
This is one lawsuit where I think neither party should win. I don't think anybody should be able to copyright the use of a single word, esp for all things like Mojang is trying to do. However, Bethesda is trying to defend their trademark of The Elder Scrolls, which happens to use the word Scrolls in it, and that would prevent anybody, not just Mojang, from using the word Scrolls in the title of something. It's that "edge" thing all over again. So, if I wanted to make a game called, say, The Elder Craft, who do you think would sue me first?
@SauhlGood - You have to look at this from Bethesda's point of view. "The Elder Scrolls" is a hugely successful franchise that they make hundreds of millions of dollars from. Along comes Mojang who attempts to trademark the word "Scrolls" for EVERYTHING. I'm sure Bethesda is very scared about that, even though they hold the "Elder Scrolls" trademark first... which would hold president over Mojang's "Scrolls" trademark. Still though, Bethesda can't take the risk of themselves being sued by Mojang over the trademark. If the "Scrolls" trademark was granted to Mojang, they could perhaps sue to prevent the release of any game with the word "Scrolls" in the title.... such as "The Elder SCROLLS: Skyrim". They would probably lose the suit, but they might be able to get the games release blocked until the case is settled.I know the Minecraft fanboys out there think Notch is some sort of god (hes not, hes an idiot who made a very simple game that happens to be extremely fun), and that he would never do anything underhanded like that. Thats fine for you to believe that since you don't have hundreds of millions of dollars on the line if your wrong.
@olomanna Mojang wants to copyright the word scrolls in every form possible. This means if they won the lawsuit, no one could use it. E.G No one allowed TV show called ' Scrolls', no one allowed a book called 'scrolls' etc.
C'mon f#¤king babies that sues Mojang. You can't have trademark on one word. Then blizzard shall sue World of Tanks because "world of". And what is the reason? There is no f¤#king reason except money... I hope Mojang win in the court but I will still buy Skyrim :)
honestly this is worse than childhood bickering, ...nobody with any sort of clout in video gaming will confuse "scrolls" with "the elder scrolls" its is a portion of their title "The Elder Scrolls" ...anybody remember that HUGE legal battle between Lucasarts/Fox' "Star Wars" franchise vs and Paramounts "Star Trek" over the use of the word "Star" in "Star Trek"... oh thats right, there was none! even with similar scifi themes these two never felt threatened the audience would confuse a star trek movie for a star wars one... i wonder if Mojang was a bigger company would Bathesda be doing this? theres a special place in hell for lawyers like this (apologies to the good ones)

Bethesda can go ***** themselves. This just dumb and very very low. Especially since they are extremely overrated like Valve in my opinion. The difference is Valve has contributed Steam... Bethesda not so much. I basically play Bethesda games (Fallout and TES) for maybe 10 hours and then get bored because of the awful graphics boring story and no real drive to do anything. Open world games are great but you need reasons to do quests besides Gold and a crappy Rusty Iron Dagger of Crustiness. A big landscape means crap if you have to run around 5 minutes just to kill one wolf and the story line is told through text and conversations with the same voice actor for every quest.. :P At least Mojang made an interesting game.
