    A Federal Judge recently threw out a lawsuit by a former Democratic member of Congress against the pro-life group the Susan B. Antony List (SBA list). The Congressman sued the SBA list after losing his re-election bid in the 2010 Congressional elections. The Plaintiff who had campaigned as a pro-life Democrat, was one of 20 pro-life Democrats who were targeted for defeat in the 2010 elections by the SBA List (of those 20 Democrats, 15 were defeated) based on their decision to vote for Obamacare, pro-life groups including the SBA list opposed Obamacare because of concerns over abortion funding and conscience rights. In the 2010 elections SBA list ran ads against the Congressman criticizing his vote in favor of Obamacare as being a vote in favor of funding abortion with tax dollars. The Plaintiff sued SBA list for defamation and "loss of livelihood", arguing that he did not vote for tax-payer funding of abortion.

    The Judge has now dismissed the lawsuit, ruling that:

    "The concomitant principles of free speech and truth collide most violently in the arena of political speech. During the recently passed national elections, citizens were bombarded with political advertisements that the targets of which daily denounced as lies. Who then shall be the arbiter of political truth? Ultimately, in a free society, the truth of political back and forth must be adjudicated in the marketplace of ideas,".

    Essentially in the court's decision, allowing defeated politicians to sue groups for politically related ads would be put too much of a burthen on free speech and that is the role of the voters, not the courts, to decide which criticisms of political candidates are true, false or debatable.

    What do you think of the ruling?

    I would say it was the right decision, afterall if courts were to be hearing lawsuits over things alleged by political ads they would probably have their dockets pretty darn full.

Educating - from the Latin educere - means leading young people to move beyond themselves and introducing them to reality, towards a fullness that leads to growth. This process is fostered by the encounter of two freedoms, that of adults and that of the young. It calls for responsibility on the part of the learners, who must be open to being led to the knowledge of reality, and on the part of educators, who must be ready to give of themselves. For this reason, today more than ever we need authentic witnesses, and not simply people who parcel out rules and facts; we need witnesses capable of seeing farther than others because their life is so much broader. A witness is someone who first lives the life that he proposes to others.

    sounds like the correct decision.. but on the flip side allows for complete lies attributed as facts in political advertisements calling it free speech.... doesn't that clash with anti-defamation laws though? or is it supposed to be understood to voters that political ads are all bull--t?

    I agree with the judge. Through out much of our history Judges have been a better job of fighting for our freedom and common sense then our politicians. Now they aren't perfect but hey should be commended overall

    Actually there is no statutory language in the bill restricting abortion funding, the House version had the Stupak Amendment but the Senate version did not include it, that is why it took so long for Stupak and other Democrats in the House to vote for the bill.
