I remembered a similar incident when some kid bought Madden on the 360 and it turned out to be a "different" type of pornography.

Yeah, its happened at best buy before too. I worked in the computer department for about a year - we had this meeting regarding thefts. My best buy had 983274983274 DS's stolen it was pretty crazy; xbox 360's, too (and in the same way usually - we had an X360 box with a giant boulder in it)

Its not suprising its wal-mart if thats a clue, they continuely and often try to resell broken items as new and used items as new.
I've returned items before only to see them back on the shelf presented as new.
