You seem to beconfused about what "loked a X frames per second means".
It means that the game will never go over 60 frames per second, but in it's most graphically demanding moments, could very well go down to 1 frame per second (just giving an example). So, of course that "loked at 60 fps" means that the framerate can go to whatever number below and including60. That's how it's always been and always will be. Even the beat'em up 2D games like Street Fighter 2 or whatever game you like, had variable framerate depending on what was happening on screen, even though they were capped at 60.
Loked at 60 is still excelent news and it means that for the most part the game will indeed feature a strong 60 frames per second (excluding those intense graphical moments like extreme close-up explosions which, depending on the optimisation of the game, may or may not affect the framerate), which deliver a somewhat faster and smoother action compared to a 30 fps lock.
