I don't think this should be a criminal offense at all actually. She should obviously lose her job as a teacher though. But as long as men are being locked away for long periods of time for doing the same thing, females need to be held to the same standard and not given special treatment or less punishment

As hot as the thing is in reality, to my understanding this is statutory rape, not to mention the violation of the presupposed professionalism of student-teacher relationship. She was involved with 3 different students, and even got impregnated by one of them and already gave birth to the child. That's just so wrong and reprehensible on so many different levels, and she only served 6 months. That's kind of a head scratcher. So despite the obvious ridiculousness and absurdity of the plaintiff's allegations in the resulting law suit, I hope he wins.

Does it actually say why she was released?

Well, considering the fact that most cultures treat women as benign, I'm not surprised by this.

best part:

Whitehurst invited the student to drink alcohol, the suit alleges, and had sex with him. When she became pregnant, she claimed that the child was a “miracle” and the result of “divine intervention,”

this is why I prefer younger women..

What exactly is he suing her for? Having sex with him, or for accidentally getting knocked up?

either way, I don't think he deserves anything, he knew what he was doing and what could happen.

plus, she has a child to take care of and has no job - I think she needs that money more than he does.

agree completely. maybe the girl will be punished but the guy deserves no compensation at all. First getting laid and then getting paid for it also while the girl serves time in jail and brings up the kid ??? The guy is also responsible, punish them both i say =P

....uh, while it is true that it requires at least two people to have sex, that does not mean that both parties consent to it

Because he was 16 at the time, so legally speaking he couldn't consent to it.

I was talking in the general sense. But since this was in California, a 16 year old legally can't consent, let alone an intoxicated 16 year old.

while i agree the teacher seduced the student and others and what she did was wrong. But she served jail , already lost job , maybe get more prison years and above all has to take care of the baby. Wrong is the guy asking for compensation when news stating he had a passionate affair with the teacher as well. I'm saying the guy deserves not a penny. He had his fun :)

the double standards with a touch of hypocrisy.

#29 Edited by TwistedShade (3138 posts) -

Couldn't help but notice the lawyers want the student to get full custody, exactly how does an 18 year old college student expect to raise a baby? I assume he'll get help from his family but that seems like an burden not just financially but overall for them.

Its a stupid law though isn't it...

a 16 year old boy has probably been dreaming of sex since what? 12-13? I know alot of people from my school year and others that started having sex at 13-14. the boy damn well consented, everyone knows it. hes not even claiming he didn't consent....

The teen’s lawsuit seeks compensation for emotional and psychological damages

I think the only emotional damages he's having is anxiety over the idea of potentially having to raise a kid.

It's all about where we draw the line.

I think it's best to keep the legal age of consent at when they officially become adults.

But, at the same time, we shouldn't be treating people like this guy as victims; they're still responsible for the choices they make.

Oh yea, I'm fine with the line being what it is. but he is no victim. I would of slept with a hot 29 year old teacher at his age no questions asked. hell... any hot female teacher was an obsession for most teen boys...

question is what did she in them for gods sake? :P

@The-Apostle: and that right there is where inequality is shown.. Where women demand to be treated as equal with men but usually has lesser sentences when it comes to this.

Seeing how the OP left out most details pertaining to the incident, I thought I'd clarify. It didn't do much though, posts with the attitude of "hawt, lucky kid should stfu" are prevalent.

By what kind of f'ed sexist logic does kid deserved to get punished? Having sex with minor is an offense even if there is consent. Having sex with 16 year old girl would be called statutory rape and perpetrator gets locked up. And when genders get reversed even if it sounds like plot out of porn land it still is wrong and teacher knew that and is paying for that
