A federal judge has ruled that the Death Penalty as applied in California is unconstitutional, due to the uncertainty as to whether someone on death row will actually be executed or not. Most death row inmates in California prisons wind up dying long before they're executed due to a number of reasons, such as appeals and arbitrary selection. Hence, most of them are constantly stressed and anxious because they don't know when or if they'll ever be executed, which, in the opinion of the judge, constitutes cruel and unusual punishment.
