Witcher 2 studio sued by Namco Bandai

CD Projekt Red's DRM-free downloadable edition, distribution deal with THQ allegedly ran afoul of existing deal with Tekken publisher.

Last month, Witcher 2 developer CD Projekt Red took a victory lap of sorts, announcing that its PC role-playing game sold through 400,000 copies and would soon be receiving an Xbox 360 port. That celebratory mood may have since faded, as a CD Projekt representative confirmed for GameSpot today that the developer is being sued by the game's European distributor, Namco Bandai.

Namco Bandai is accusing CD Projekt of sorcery and breach of contract. Mostly the latter.

According to a report on Dark Side of Gaming, Namco Bandai is accusing CD Projekt of breaking its contractual obligations with the publisher twice over.

The first violation allegedly occurred when the developer released a downloadable version of the game free of digital rights management through its own online storefront, Good Old Games. The second breach was said to have occurred when CD Projekt signed a distribution deal with THQ to bring the game out in Western Europe, Australia, New Zealand, and the Middle East.

Beyond confirming the existence of the suit, the CD Projekt representative could not comment on the case. A Namco Bandai representative was also unable to comment.

The Witcher 2 is a direct sequel to CD Projekt's original and picks back up with professional monster slayer Geralt following a failed assassination of Temerian royalty. Geralt then sets out on a quest to track down the king's attempted killers, while also continuing to pursue those responsible for murdering other witchers.

Oh boy there goes the Xb360-version of ('The Witcher-2'), like that of the Xb360-version of the first Witcher game! If you-all remember it was going to be titled ((The Witcher: Rise of the White Wolf))!!, It no-doubt has to do with one thing, and one thing only, everybody say it with me (GREED)!! I.e. everybody wont's a peace of the pie, more so if they know in advance that that pie is going to be one hell of a big-pie indeed!!!!!! I for one hope CD-P wins big-time because this Dev. really stands by and with the gamers who bought their game!, To be fare tho, and of course we'll never know for sure, but CD-Projekt may have, and I said (may-have) over stepped (their) bounds i.e. got too greed themselves.

I was so sad when I first tried the game on my LAPTOP and found out that it only works on MEDIUM setting and sometimes it laggs,,,,,,until recently when CD PROJEKT announced XBOX360 version of the game,,,,,,though it would have been better if it was announced for the PS3 because I am sure it will need more than 2 DISCs on the 360..........

you can obviously see that all namco is after is a piece of the cake...really...they are ready to sabotage CD projekt over an amount of money...i hope cd projekt has a solid back...otherwise just declare banktruptcy,,screw over namco, rename the company and continue with the IP.... but all and all namco is acting like retards...i am sure there is a way to resolve this without resulting in a lawsuit... and namco is super dumb...like i said previously , they may win the lawsuit if this persists. but this will be a big PR blow to them. and i am sure that cd projekt will not even get close to them if they decided to make another game... its gonna be a quick cash grab for namco but in the long run they are gonna lose more than they will win if they can find a settlement...i am sure a lot of people will actually dont buy namco games because of this... all i can say is Namco...epic fail....

@ sixt5mustang Your talking about half of the story. CDPR themselves say that the contract says it was ONLY for the PC release...not the 360 version.

When will they learn that no matter how hard they try their games will get cracked... sure they can delay it with a week or two with their fancy DRM but it still gets cracked. Not to mention that a DRM that can mess with the crackers will probably ruin the game for the real costumers, it's really just a waste of money. If anyone can understand this then a company as greedy as namco must.

Breaching a legal contract can be serious. Especially, when you're talking the dollars these guys are playing with. If CDP had a contract with NAMCO, then NAMCO undoubtedly put a lot of money into the publishing process. For CDP to not honor their end of the deal would be a big middle finger to NAMCO, its shareholders, and its employees. This isn't a popularity contest either. No matter how good of a developer CDP is, which I think they're great, they aren't above the law, and NAMCO has every right to sue if their claims are true. How would you feel if you signed a contract to do work for someone, put all the time and work in to being able to get the job done for them, only to have them come back and say that their signature and deal with you means nothing, and your time and work means nothing- they've found someone else?

Like it or not if a big developer's big game, brakes a big contract with a big publisher, there's likely going to be a big lawsuit. We don't know the exact details but Projekt Red seems to think that's it going to win. Good luck to them if there in the right but arguments like, Scamco suck cokks your soul calaber 4 was crap II LIEK Projeck red better. Well that's not going to hold up in court.

@Olgark I second that. IF the contract states exactly what is on Dark Side of Gaming, then the court will definitely toss this out...Namco will have to pay CD Projekt Red for the retail copies and will also have to suck it up when the 360 version comes out.

Namco are being greedy, Their contract was only to publish the European PC game, nothing in their contracts mentioned console games. As for the DRM it sucked bad as hardly no one could play the game until CDProjekt unlocked it for them. I am going to stop buying Namco products until this is resolved.

@michaelrodrigue even i faced similar problems, have custom aftermarket coolers, try to keep the case open while u play, remove the dust from the gfx and processor fans, if things still ain't looking good, try to change your PC location to a more ventilated space. Try some cable management in your case. Hope this helps. I went through the same things, and i tried all of the above and i am playing happily ever after. Peace

i have HD 6970 in crossfire configuration and an intel 990x processor. is there a patch that will allow witcher 2 graphics to be fully realized. my setup currently overheats and shuts down.

hmm.. that's a bad news for CDProjekt... since Atari already acquired by Namco Bandai, there must be some policy changes.. :roll: actually Larian Studio "Divinity II" also made a similar contract with Atlus co. & Focus entertainment not so long ago. and Its common among publishers, why do Namco Bandai bother with that.

Maybe if Namco loses, CD Project can make them localize all the good games they never let out of Japan. But who am I kidding, this is Namco we're talking about here :lol: Well off to play more Witcher 2.
